I do have one question: I had 7 months unlawful presence before I filed my original application. If ICE encounters me, can they still detain me even if my I-360 & I-485 are pending but because I had 8 months unlawful presence before filing the application?

like Rhema1 said if you have really bad criminals history then you need to worry about other than that you are fine. Just keep your EAD with you all the time now.

Thank you both! I don’t have any criminal history. But I have been reading that ICE is even picking people with non-criminal background and hence scared. I have C09 EAD and I plan to keep it with me all the time.

 if illegally present. They aren't picking up people who have authorized stay, to my knowledge.

Illegally present means deportable.  Tom Homan has said they will pick up people illegally present.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Don't keep listening to all what people are saying on social media.

You have nothing to be afraid of as far as you have a legal stay here in the USA and without any bad criminal history.

So if I had unlawful presence but then got pending I-485, I am authorized, right? Just scared of the power trip ICE is showing for to detain people in such a circumstance (no criminal history, though).

I have seen no examples of people with authorized stay being detained.

I mean, I don't think this should normally be a problem but then again ICE is ICE. The pending I-485 gives you a period of authorized stay while that's pending. I'd keep your EAD and ideally a copy of the I-485 receipt notice on your person if ICE has been spotted poking around the area. 

 .

You are not an illegal alien with a pending I-485 and with a C09 working permit.

As @Demise said, always keep a copy of your I-485 receipt notice on you if you are too scared 😨 of ICE.

They will never deport you unless you have a huge criminal record.

This is true. We all intuitively present ourselves as 'good' so I don't judge anyone. However, a lot of folks lie and twist narratives online. Also, regarding ICE and pick ups, the goal post shifts daily. I fear for anyone who had unlawful stay under this presidency. Even Elon is 100% safe. Just make sure you don't post your true feelings online, speed or act as though you have 2 American parents.

We will all be alright very soon.

Thank you so much, fam! I have been getting so anxious because of all this that it has impacted my sleep and work performance. My work keeps me busy and I’m glad for it otherwise I’d go crazy. I’m a March-2022 filer, did everything on my own (without an attorney) and haven’t received an RFE yet. I do have a 5 year combo card. I’m expecting a response soon as the trend shows they’re working on Jan-Mar 2022 right now. I hope I get approved without an RFE by the grace of God. I will let you know as soon as I hear something.

That's the spirit! keep yourself busy. Hopefully you will hear positive news soon. Valid EAD always great to gave to keep yourself busy. I personally took advantage of EAD in full, used it for work and travel.

That's right.

I also never heard of someone being detained with an authorized stay.

It's only unsubstantiated rumors destined to make people afraid.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
