I-824 stuck, Can I try to get it unstuck by filing I-129F?

Odd question.

When I applied for my spouse I-130, it got stuck and I got it unstuck by using a trick that others on Visa Journey used by filing a I-129F. It worked very quickly.

Im wondering if I can do the same for my stepson. It is stuck at Potomac, but with an I-824 (send approved I-130 to NVC).

Any thoughts? Anyone tried this?

Thanks.

1.  An I-824 is used for to move already  approved I-130s.  It does not apply.

Yes I understand that, but I know odd things sometimes get things moving. Just a thought.

Ive tried many service requests, expedites, ombudsman.

I cant get estimated time due to it being Potomac. It isn't listed on the website. I asked multiple agents on emma live chat and none of them can give me an estimate.

Im about to have to do a writ of mandamus, but that is pretty expensive now.

The thing is I didnt even need an I-824, due to my I-130 stated that I was processing out of country, but USCIS made me do it. I didnt have to do it for my spouse, but they are forcing me to do it for my stepson. IDK.

I assumed it was your error

I get it. everyone is frustrated with immigration. It keeps getting worse. It keeps taking longer. It seems one or another sect of ppl get through faster than others or someone just won the jackpot and gets through in record time.

But the county we r from isnt safe. Its extremely hard for ppl to understand if you’ve never been. When ur worried about life and death you look at any possible way to keep someone you love alive.  That is all Im doing. Just searching. Trying not to give up. Hoping that he doesnt die before the end of this.

Pro Tip

Very difficult to make more than general responses to questions where only partial information is provided.

Obviously the situation is very different where USCIS has made the error, expedite is available.

They rejected expedite even though they admitted to the error.

Clear USCIS error.
Not every circumstance that fits in one of these categories will result in expedited processing.

For more information, see USCIS Policy Manual, Volume 1, Part A, Public Services, Chapter 5, Requests to Expedite Applications or Petitions [1 USCIS-PM A.5].

Not sure I have seen a case where there has been a clear error and it has not been expedited.

Thanks. I might try again.
at the moment I’m waiting on a tier 2 call back due to 3 service requests going unanswered.
last time I waited for a tier 2 call back I wasnt called. They just emailed me and said  they weren’t going to call.
