K1 visa with medical waiver

My boyfriend and I have been talking online for almost 2 years. He still cannot travel because of his medical condition. He had a big wound on his right foot which got worse because he is diabetic. He is still in a wheelchair because he's not allowed to use his right foot. Can we process k1 visa with medical waiver? What documents do we need to submit? I hope somebody can help us.

Meeting is a basic requirement for filing.  It is there for good reason.  Some have tried, but I have not seen a single successful waiver for the 2 year meeting requirement since I came here 8 years ago. You can try, but I would not expect a positive result.  Personally, I would wait until he is able to travel outside the US.  Good luck.  I hope you can meet soon.

Which country are you from? Have you tried to get a B1/B2 visa to visit the U.S.? I would try that first before you submit a waiver… 

Then research alternative meeting places… only then should you submit waiver with medical proof and attempts to meet in a different place.

Did his doctor specifically tell him that he is not allowed to travel at all? Wheelchair assistance is available at airports and for flights, so that could be an option. Depending on where you are, you might want to meet somewhere in the middle or a little closer to him than to you, because I understand that a 12-hour flight for example would not be ideal for him.

I am from the Philippines. I wanted to try and get B1/B2 visa instead but I do not have something to show them that I will surely come back to the country like properties.

No.  USCIS expects you to meet in a third country or your country to fulfill the requirement.

 

Hopefully he has a plan for how he can afford to petition you and support you financially.

You can try a third country.   Btw, people in wheelchairs travel all the time.

It is not likely that you’ll get a tourist visa approved, sorry.. Try to find a country that you can both travel to relatively easy. As mentioned before, he can ask for assistance at the airports he will fly through.

 

It doesn’t sound like he is bedridden, and even though it might not be easy, he should still be able to travel with some assistance.

Diabetes with a wound (even a hangnail ) often leads to gangrene 

and is very serious 

I have 2 cousins with diabetes  who lost a foot and /or leg to a foot wound (one was just ingrown toenail)

diabetic individuals should even go to dr to have nails trimmed

and that is why this person has my prayers
