The question : I just need you to ask if I should file as head of household for tax purposes under tax code 7701B4 or file a join return married to a non-resin spouse

Aren't you the beneficiary?  If so, why would you file taxes as head of household?  The US spouse would file as Head of Household (if qualified), Married Filing Separately, or you and US spouse can file a joint tax return (if you have an ITIN or SSN).  I see no reason for you to file a separate return.

The USC spouse needs to ask a tax professional whether she is eligible to file as HOH.  My guess:  no.

When I got married in 2021 with a K1 visa for my spouse, (who returned to his country before the AOS was completed and we filed for a CR1 visa,) I filed my taxes as married filing jointly and the first time I filed I entered all 9's for the SS number for my spouse along with the application for an ITIN in the interim.  It took a long time to get the ITIN so when I filed for 2022 I did the same thing and my return was handled fine.  When finally the ITIN was approved then I filed amended returns to include the ITIN and once he received his SS after coming back with his CR1 visa, I did amended returns again with his SS.

I filed mine as married filing separately and plan to amend mine as married filing jointly once my husband gets a SSN. Head of household would depend on your situation if you have dependents or not. The only way that you can’t file taxes is as single if you’re married.
