Proving Domicile?

Hi everyone,

 

My husband and I are in the very early stages of our Immigration journey. He is a US Citizen that has been resident in Ireland, where I am from, since 2017. He was on an Irish student visa for 4 years, 2017- 2020 and then he was on a Graduate visa for 2 years. We got married in Ireland in March this year and he was just approved for an Irish residency permit for one year.

We are now planning to relocate to the USA and he is enrolling in a Masters program, starting in June. To try to shorten the amount of time we will be apart, we want to file the petition for the CR-1 Visa as soon as possible but we are concerned about him proving his domicile at time time of filing, even though he will be living in the USA from June 2024.

 

Does anybody have any advice on proving domicile from outside the USA?

Proof of domicile will not be needed for about a year...at the NVC stage of the spousal visa process.  He can file the I-130 now without proof of domicile.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You might want to look at the possibility of DCF

Thank you both for the advice!

 

I dont think we would qualify for DCF as I just looked at the Exceptional Circumstances and none seem to apply to us right now and there is no Field Office in Ireland unfortunately :(

I assume London covers Dublin but if you do not believe you have a basis then it does not matter.

I assume London is the Regional Office, I would be surprised if it was not.

Consular in London should work for DCF if the case qualifies:

FWIW, I asked Dublin embassy earlier this year about DCF and they said they don't do it. But yeah, definitely get started ASAP and you won't be worrying about domicile for a while.

Kinda like how Stockholm covers Norway…..

I wanted to be abroad for less than a year with my wife in our wait and wound up staying 20 months, which caused a domicile RFI, where we responded by paying for a US apartment(employer was in US remote). Its easy to say 1 year on paper, but as anything could happen, a letter from family as your domicile is one avenue in alternate to a rental contract, and associated fees. Employment offers are also valuable, though current employment may be better (by US employer.
