Yes you can file anytime after 2 years and 9 months of being a green card holder and living together still married. So whenever you're ready. I Don't remember what we were uploading, cause it's online filing, but it wasn't hard or complicated at all. The N400 form is also pretty simple.

Apply for N-400 if you want to become a US citizen. Becoming a US citizen is not mandatory, it's optional.

 

If you apply based on marriage, sure you'll need evidence, a little less than for I-751.

 

If you have been a resident for 5 years, you can apply based on that and you won't need to submit marital evidence other than marriage certificate.

Thanks a lot. That brings some ease on me thinking about the amount of work we had to put in to gather all the evidence for I-751.

My husband is the one applying. He has been a resident for almost four years now. So basically, if applied based on 3-years rule, the marital evidence is needed but not when the 5 years of residency requirement is met, correct?

Yes. I got my GC based on marriage, but applied under 5 year rule. At that time my I-751 was approved.

This is all my wife and I had to upload for her N-400 based on the 5 year rule:

 

Letter requesting a combination interview (optional)

5 years Tax transcripts (optional)
Proof of my 1st marriage Termination
Proof of Wife's 1st Marriage Termination
Wife's Green Card
Our Marriage Certificate

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you. It doesn’t seem overly complicated. We might wait another year to file under the 5-year rule. Hopefully, his pending I-751 gets approved in a meantime.
