Just make sure your daughter is listed with the school after she endorses the visa as a non resident student. She will be able to return to the US on breaks/summer and return to school to finish her program.

Just re reading this thread tonight @Ontarkie, just to clarify, so she needs to tell her uni in Canada that she is a non resident (non permanent resident) once the US visa is endorsed. what are the benefits of this? Can’t she return to us on breaks /summer anyway? I’m not following at all , but then again it’s late and I’m knackered 😄

What I fear with this is..The only reason she is able to get her student loans is because she is a permanent resident of Canada

thanks for any clarification

She will no longer be a resident of Canada when she crosses to endorse that visa. She can't claim to be a Canadian resident after she enters the US with her visa claiming to be a US resident.  One of the requirements as a US Permanent Resident is the US has be your residence. Being away for school is not a permanent resident, if she claims Canadian residency that can put her green card at risk. So not Canadian Health care either.

I'm not sure how the student loans will work. She will have to look into that more. I know they don't give you any relief when you move to the US.

Hello, we were denied EB3 Visa in 2019 and our daughter therefore started university in Canada (permanent resident). We have recently received reaffirmation and approved on this Visa, however daughter is halfway through a degree in Canada.

I am now aware that when she crosses the border to endorse her US Visa, she will lose her PR status in Canada? Therefore she will lose her student loan I believe

Has anyone else been in this situation and apart from transferring schools to the US is there any way around this?

My plan was to apply for a re-entry permit in the US so she can carry on her studies in Canada.

I’m going to be calling Alberta student loans, but of course it’s Saturday today so I can’t

if there is no way around this, could she apply for student loans as a US resident studying in the USA?

That part is not necessarily right.  She will no longer be a resident of Canada, but she does not necessarily lose her Permanent residency.

Being a resident might be needed to get student loans though, you will need to check with her province  How old is she? If she is an adult with her own life, it might be better to stay in Canada.  She will have to compare cost, other benefits, and downsides...

This is what I thought, she won’t lose her pr status in Canada

she is 21, she is a permanent resident, so she can get her student loans still I what I thought, the idea is that she would stay in Canada (therefore be a pr) .I would apply for a re-entry permit so she can carry on her studies and then come to the US when completed in under 2 years

thanks for any input, I’m thinking this through and it seems she won’t?

Being a Permanent resident of Canada, while taking residency elsewhere, doesn't necessarily mean she can get student loans though. She will have to check on that herself with the province where she's studying.

She will not stop being  a Canadian PR holder per the Canadian guidelines. But she won't be a resident of Canada. She can't be a resident in Canada and be a permanent resident in the US. Don't confuse keeping her Canadian PR as the same as being a resident in Canada.  Just like when you move from one Province to another you are not a resident of two Provinces you're only a resident in the one you will be actually living in.

The US does not allow PR holders to live permanently outside the US. It is grounds to revoke that GC. This is why she needs to be listed by the school as a non resident student. If she claims  being a resident of Canada and/or uses Provincial health Care, that is only available to Canadian residents the ones who make Canada their permanent home. It's not for Canadians or Canadian PR's who no longer make Canada their permanent home.

She will no longer be a resident of Canada once she enters the US and endorse the visa declaring her PR status in the US. For immigration she can only be a resident of one country and she will stop being a resident in Canada they day she endorses the visa.

Thanks ontarkie, I think this is going to be the challenging bit that I’m not going to be able to find in any definitive online information, if I do it will probably be conflicting.

I’m going to call the student loans people tonight but I have a hunch that they won’t really know the answer. Who is the absolute best person that I could speak to regarding this, anyone know if there is a representative that I could speak to  directly at canada immigration offices to ask; daughter is a current permanent resident of Canada and entering the US, but coming back on a re-entry permit to finish off her studies.

To determind residency in Canada they use CRA to make this call  here the link https://es-cpas.com/residents-of-canada/leaving-canada-when-are-you-no-longer-a-resident-for-tax-purposes/#:~:text=you usually become a non,the country you settle in

YOu have two issues here. If she continues to claim Canadian residency even with reentry permit she can lose her US PR. THis is why she needs to be listed as a non resident at the college.

Right I have an update, I tell you I have been on my knees these past few days, and the last thing I needed to be doing is personal care and chatting to the elderly about knitting, I’ve been so stressed. I think I can now relax.

anyway! I have just called the student loan Alberta, and they have said if she changes her status with the University from resident to non-resident, it will be fine she will still be covered for her student loan, but as an international student, so basically she still gets her student loan.

No, my next hurdle is to work out how we go about her listing as non-resident for Alberta health care 🥴

thank you to all that are helping me through this. I am working 15 hours shifts and it’s incredible hard.

That is great news. Glad that part is is figured out.

Health Care she should talk to the college. I know when I was going to school I had health care through the college in Ontario. ALberta might have something too.

The registration office should be able to help with changing her status.
