Hi! Everyone I'm new for this website. I thought it should be useful for our

situation. I and my boyfriend decided to get married but i just found out that my boyfriend

had been arrested for DUI 3 times, but he was off probation about 3 months

ago. He is free now. But I'm worry about his record because he was planing

to file petition for my K1 Visa. And i'm really worry so if anyone has suggest

that can help us please don't hesitate. Becuase we were planing to submit

the petition in 2 months. we really appreciate your help!!!! :help:

you have no timeline so no one can tell where you or your boyfriend intend to file from .

I have no idea where your boyfriend resids , but for example here in canada being arrested for DUI is a very big thing , ( its just an example but if someone trys to immigrate to canada with a DUI record , first the have to apply for a pardone ( application for rehabilitation ) that can take month to a year before its completed , then since it has happend mulitiple times very big chance for denial , but like I said the law in the states might be differant for entry on DUI charges , if you would fill in your timeline I belive someone who knows the law in the states about entry with DUI charges will be able to help you more

Hi! again. Ok This is more information.

My boyfriend is American citizen. He lives in Pensylvania.

and now i'm here in america in New Jersey , but my Visa is up

in October. So he was planing to file petition for me around September before

my visa is expired. Then i have to go back to my country and apply for K1 visa

from there. My concerning is i'm not sure that his petition is gonna get approved

because of his DUI records. So if anyone can help us please!!!! we don't have much time

Well,

I don't think HIS DUIs matter much. He's a US citizen, they can't kick him out :lol:

I rather think you may have better luck with marrying NOW and submitting Adjustment of Status and Advance Parole ASAP. Then, you could go out of the US for up to 6 months worry free, right?

Otherwise, I am not sure if one can apply for K1 when his fiance in in the country. If one can, then there is no point to be waiting until you have 1 month on your visa. You might as well do it now, depending on where he lives, K1 will be sent to US embassy in your country in 2 - 4 months. But, if you get caught in security checks, it may be longer...

So bottom line - why complicate matters, just get married now!

sorry to say but Rika you doin the same mistake I did in the past but I did learn from my mistakes , giving some wrong info

yes your right about them not being able to kick him out since he is U.S citizen , but the AOS aplication while on a tourist visa ( hmmm very questionable ) ,

she should get more info on it cose to my understanding that could be visa fraud if you came to the states on a tourist visa in intentions of marriage

my advise is ask someone here with a lot of experience in that situation , ( like yu-dan . Dr-La , Pushbark if you read any posts when they replied you will see theyr advice is right on the dot , very good advice ,

why would you not be able to file for K-1 while the two are in the US together? there's even a space on the form for that...

and Rika, be VERY careful about advising someone to marry immediately; if they do so, and are deemed to be in any way in violation of their current visa, they could be done for visa fraud...

I'd say play it very carefully, OP; don't do anything rash :)

doesn't SOUND like the DUI convictions are going to be a long-term worry (except that you may have second thoughts about being a passenger in his car), but you'd do well to look into that carefully too :yes:

I thought the only problems were related to violent crimes. As far as I know DUIs are not felonies. Was anyone injured?

22 Jun 05 - We met in a tiny bar in Williamsburg, Va. (spent all summer together)

27 May 06 - Sasha comes back for a 2nd glorious summer (spent 8 months apart)

01 Jan 07 - Jason travels to Moscow for 2 weeks with Sasha

27 May 07 - Jason again travels to Moscow for 2 weeks of perfection

like i said we don't have much time left. Here are some more

information. now i'm on J1 visa for almost 2 years not tourist visa though :yes:

I have been know my boyfriend for 3 years. so like i said

i would like to go back to my country after my program on J1

is up in october. and my boyfriend wants to file petiton for me.

so i can come back here and get married.

but thing is he had 3 DUIs, but he off probation now and got

his license back. so I just would like to know that is he gonna

get any problem when he file the petition for me? i know it's a

big problem but what would we have to do? :help:

He probably won't make it with a K1. There is the question about 3 or more convictions related to drugs and alcohol not stemming from a single act on the form itself. I guess if he hasn't been convicted of the third DUI yet, then it's only two so far, but still....

Also, like others have said...do you really want to be with someone who has a drinking problem and then goes out and risks his life and the lives of others 3x DUI? I mean, he was CAUGHT three times, which means he probably drives drunk regularly and doesn't think it is a big deal. What sort of person is this?

Hey folks- how about we keep our responses to what the OP is asking? Not our biz if boyfriend has or not a drinking problem :no:, me thinkssssss, in good faith.

OP: Be careful about "marrying NOW", because it does constitute visa fraud.- Though I am no expert, so you can always consult an attorney for more precise information on your options.

Like the previous poster said, convictions related to drugs and alcohol kind of matter - to what extent I am not sure: again, double check with an expert.

Any chances of you extending your current visa for a while?

In any case, I wish you the best of luck.

The reason the drugs and alcohol and violent crimes questions are on the forms is to protect the non-US citizen from pulling their roots, coming over here, getting married and possibly getting into an abusive relationship where they may get hurt or possibly killed.

If it was a first arrest and s stupid mistake on one DUI it is a bit different, but three times is a huge red flag. They also check the US citizen out, so they will pull her boyfriends records, so these things will come out and affect their situation.

I wish every single person on here the best and hope they have a solid partner and a great relationship, but if someone posts something that really raises questions or you think they may want to examine things a bit closer, then what is the harm in trying to watch out for someone else.
