Got EB-1 approved (current date April 24 - 2023) - please help!

Dear Friends,

I hope this message finds you well. I wanted to share some exciting news with you. I have been granted approval for my EB-1(A) application, and the current date of approval is April 24, 2023.

I have a question regarding my daughter's eligibility for the status of adjustment (I-485). She is a Canadian citizen by birth and was included in the I-140 application. As of the current filing date, Canada is listed as "Current" in terms of visa availability.

I am the principal applicant, originally born in India, and I understand that India's priority date for September 2023 is not yet current in relation to my application.

I would greatly appreciate your guidance and support on whether my daughter, as a Canadian citizen by birth, can apply for adjustment of status (I-485) as the secondary applicant for the green card.

She cannot adjust without the principal adjusting first or at the same time as secondary applicants. So you'll have to immigrate/adjust first before she can adjust.

No she cannot adjust by herself as she is dependent
