Hi, I am a US citizen and I filed I130 in January to bring my brother. The petition and is at California Office and all I received is a receipt letter back then in 2012 saying they received my case and didnt budge since then. I checked the processing times and shows the case is outside normal processing frame. I sent an inquiry and they told it is within normal processing time.

Per https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2023/visa-bulletin-for-june-2023.html priority dates of 01FEB08 and earlier are current. Approving I-130 now does not help his case and if he has children, the longer the I-130 stays not approved, the better for them.

 

Once either chart in the visa bulletin gets to 2011, start pressing for I-130 to be approved.

If he has children who may age out you do not want the I 130 processed early.
