GC approved while Im overseas

Hello, my friends.

I came last month to Brazil to stay 3 months ( gonna do a surgery here ) and I came with Passport with i-551 stamp ( expires in nov 2023 )....and also with Expired GC + 48th months extension letter ( good until nov 2024 ) - I received the letter few months after I got the stamp...

 

anyway I just received notification that my GC was approved! ( new card is being produced! ) but Im here in Brazil.....so my question is: Can I enter the US with the documents above?? I could ask my husband to send me the Green Card via USPS/FEDEX however Im afraid its gets lost in the mail.....or Im gonna have problems?

 

because I still gonna stay here in Brazil for 2 months, waiting my surgery and the doctor needs to check me after 30 days, but now Im worried if Im able to reenter the US--- without-- the new green card in my hands

Yes.

That would be too high risk for too low a gain.

 

When you return to the U.S., bring copies of your medical records. If CBP asks why you do not have your 10 year gc, explain that you were approved while under going medical treatment. CBP should waive the I-193 fee. But even if it does not, the cost and inconvenience of a lost gc,  exceeds the < $600 for the I-193 fee.

Yes, it's possible, not 100% though.

But would you rather

- Pay for UPS

- Potentially pay I-90 fee (if GC lost), $455

- Wait 1.5 - 2 years to get replacement

Yes.  You have status as a legal resident.  I would not risk sending the new GC over to you.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes

You should be fine to enter the US with the expired green card and 48 month extension letter.  You are a legal permanent resident.  If they ask about your 10-year green card, just explain that it was approved while you were in Brazil.
