I-751 Cover Letter Feedback

Eek, if I'm an officer reading OP's cover letter, you bet everything that I am scheduling an interview. 

 

I also cannot imagine any officer wasting their time reading through the cover letter example above with Exhibits A-N. 

 

We didn't send any cover letters. Just table of contents. And had interview waived.

It's a cover letter that nine point nine times out of ten isn't even read unless it's a late filing (where a cover letter is a requirement in order to excuse the late filing').

I can make a fair guess that they don't read them, based on my own experience, as I've sent three of the damn things, and the last one I got an RFIE for something that was explicitly stated in the cover letter and referenced something that was clearly included elsewhere in the package!

 

KISS (keep it simple, stupid), and absolutely do not include that rubbish about requesting an interview waiver.

I also wouldn't include asking for a waiver. That looks incredibly suspicious. 

 

FYI: we included a ton of evidence, had absolutely no red flags or RFEs during the entire process, and we still ended up with an interview. It was really quick and they barely said anything to us though. So it CAN happen like it did to us a few months ago.

1.  my first DL was from California and after 4 months we moved to MI then i changed my DL which is on current address, but my wife has parent's address(MI) since she is from MI. what should i do? should i only include my DL ROC package or both but with different address?
2. We have one Joint Bank account since 2019 i moved to US, but i started work in 09/2021 so i open an-other bank account, and in 2023 i added my wife as a joint account holder. (due to lack of info, i wanted to built my own credit score first)  
3. Utility bill which only has one person name either my name or wife (due to limitation from Utility company). what should i do?
4. since i received my CPR Card on 04/28/21, so my ROC Package evidence would start or include from 04/2021?

People send evidence for time between becoming LPR and removal of conditions.

 

The instructions for I-751 say, the evidence should be from the date of marriage until moment of filing for ROC.

 

You can decide what works for you.

 

1. Your wife should change address on DL to where she lives, hopefully that's the same address where you live.

 

2. Include everything that has both names on it.

 

3. Send both utility statements. You can explain in cover letter, such as "My spouse pays gas bills, and I pay electricity bills etc". But do call the utility companies and request both names to be added.

 

4. Already explained. At least 4/21, but I included everything from start of marriage. Do what you're comfortable with.

Agreed, unlikely is going to be read. And if read, the ask for waiving interview may have the opposite effect.

1. Either update the incorrect driver's license so they can be included, or don't include them at all (we didn't send copies of our licenses). But you definitely don't want to send them when they are mismatched. 

2. I would include quarterly statements from the 2019 bank account from date of marriage, and send the 2023 statements for the new joint account. You can include a brief statement explaining the situation, if you wish. (As a side note, if your joint accounts don't show both names, you can get a letter from the bank confirming joint account status to include with the statements)

3. If you have bills in different names, that still helps. For example, if the power bill is in your name but water bill is in her name, they still establish that you are both living there so it's worth sending some of those bills. 

4. We included some evidence from the date of marriage but tried to not overlap too much with what was in the AOS package. So I'd say our evidence was 80% post-AOS evidence, but 20% was from "date of marriage". 

 

Also personally, I am pro-cover letter, but think it is best to keep it short and to the point (fit on one page and basically just be a table of contents). Also agree about leaving out language referring to waiving the interview.

Up to you. Can be notarized.

 

My lawyer asked me to include photocopies of Driver Licenses of people who wrote the affidavits. Asking for it was the most uncomfortable thing ever, but luckily all of them are close family friends and didn't mind it 😃

 

Or you can send as is.

 

Either way, affidavits aren't the strongest pieces of evidence. Use them just as an optional addition to your case.
