Hi all. Here is the message USCIS sent us after 45 months of waiting, call after call and inquiry after inquiry....

How the hell is nothing outstanding. 45 months is way outside of processing time, especially for our field office which is Lincoln, NE. Why our case is stuck at MSC is beyond comprehension.

Good advice but not everyone wants to apply for citizenship for various personal reasons (or may not qualify etc).

 

OP- I wonder if getting the help of a member of congress (senator or congressman/woman) can help nudge your case. I know USCIS has a special liaison that deals directly with congressional support. Although they cannot influence the decision, they can inquire on your behalf. We had good experience using the congressional support route but not for I-751 as I recently got my green card.

It’s a standard pro forma ‘go away’ letter.

If you file one again you will get the same response or a variation of it, and the responses usually have no bearing on the actual state of your case at that time. 

I used to file one a month for a period of something like over three years for that filing - made zero difference. 

Honestly, just get on with your life and leave them to it. Stressing over it will achieve nothing.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Just a quick update. We got a general inquiry message that starts with OVP and ends in MSC. We didn't call or make an inquiry since the last on on 1/24 and all our other inquiries began with SRC. I don't know what this inquiry entails yet I hope it means the case has been touched and we will know something soon. But the inquiry message still says it hasn't been assigned for processing. The waiting game continues...

Timeline

Try the DHS Ombudsmen's Office.  Call them and they might even pick up!  We did this many years ago for my wife's Green card and I actually had a very nice convo with a lady there.  We then suggested it to a friend who was waiting on something and they actually moved forward.

The Ombudsman is an internal position to DHS that is supposed to put pressure on them for not following their regulations.  It's a force multiplier with a Congressman inquiry

A lot of lawyers start suing after 12-18 months of wait. You clearly waited 45+ months and most lawyers would agree, it's totally fine suing at this point.

Hi All. Thanks for all the support. I'm sorry to not respond as I had surgery and was in pain. As for why we haven't filed for citizenship is because my spouse still isn't fluent in English and couldn't pass the test. And suing would cost us financial resources that are better used elsewhere at this time in our lives/relationship. Thus we are in the peverveal rock and a hard place. The one thing that is giving us hope is that the case status on the USCIS site has updated to the OVC inquiry has been assigned to an officer as of today. This means the file/case is being 'touched'. We'll see what happens from here.

This is really annoying. First off we didn't file the 751 on 3/21/17. That was the day the 130 was approved. Point of Entry was May, 2017 and we filed 751 as required in April  19 so there is something not right with that. That would be close to 6 years for waiting to remove conditions. I swear these people are full of all kinds of that bullskit. 
 
One thing that is different is that this particular response is that it came from the local field office in Minneapolis and not from the office at the NBC. Don't know what that implies but I hope in means the file has finally been transfered to our local office. We shall see...

We have similar time lines, in june it will have been 48 months for us. Our local field office is also minneapolis and i have read somewhere they are literally one of, if not thee slowest office. It is so annoying!! I just emailed the wisconsin immigration congressman and once i sent them back a signed privacy thing, they are going to inquire about my husbands application.

Hate to see someone in the same boat but hopefully things will get moving soon.
