Hello,

Questions regarding seeking asylum under the new Biden program. I'm from Haiti. 'm here on an F1 visa. It expired on 5/31/2022. My I-20 is still valid with my school.

Can I seek asylum now?

Thank you for the advice.

There is no new new Biden asylum policy

Generally you need to seek asylum within one year of entry unless there are exceptional circumstances.

Asylum claims are not diy, you need competent legal advice.

Maybe its the program where “asylum” seekers are processed at Gitmo?

just a snippet of what’s been going on the past year. It’s really terrible and I can understand why someone may fear for their life if they had to travel there. I recently cancelled a vacation to Haiti. Hopefully OP qualifies for asylum and is in touch with a lawyer.
