Divorce tricky timing

Hi All! 

 

I had my i751/n400 combo interview about a month ago, didn’t hear anything since. My hubby was not allowed in the building so he was not interviewed with me. 

 

Fast forward to today, we have been having a lot of arguments due to different things (kids/ desired location etc) and we are considering a divorce. I know the timing is weird because I’m still waiting to hear back from my interview with the pending applications, but also want to be absolutely honest with USCIS. How should I proceed? My lawyer said I can’t amend the i751 without the divorce decree and told me to just wait it out.. but I feel awful. 

 

Please let me know what I should do or if you have had similar experience!!

@immigrant2046 sorry to hear you're having issues with your marriage. Before eyeing divorce, have you as a couple considered couples therapy? It may help resolving some issues. Maybe a compromise can be found, especially with kids in the picture.

thanks for your reply. we don’t currently have kids, and that’s where the argument started (i want kids but he doesn’t 😞). we haven’t considered couples therapy, but maybe that could help. in regards to my immigration, should I notify USCIS we’re currently having arguments and considering a divorce?

Sorry for your troubles.
 

Until there is a divorce filing, there is nothing for you to do. If you take oath before the divorce filing, there is no immigration / naturalization issue.

thank you for your reply. i had my combo interview over a month ago with no updates, should i be concerned?

No need to panic. Your pending cases at still valid until an actual divorce happens. USCIS isn't interested in whether you guys are having marriage arguments which is normal in marriages.

I'm assuming you passed the N-400 interview, and waiting for I-751 to be approved, and then oath scheduled for N400?

Also, during I-751 portion of the interview, did you or did not get any questions from IO about spouse being absent since it was a joint filing?

Sounds like husband was indeed in the building, he just wasn't allowed in.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

I see. Sounded to me like husband was actually outside the building and wasn't allowed beyond security.

Did the officer ask you questions re your parents naturalization? 

 

Did your attorney tell you you did not qualify for N-600 when he was reviewing the adjustment app ( approx 4 years ago?) 

 

 

You may be looking at N-400 denial….
