Hi! I’m recently married to a USC and we are planning  for CR1 to be filed soon. I am working in The UAE with a work visa until 2025. My daughter (his stepdaughter) is in the Philippines (minor). Can he petition both of us at the same time? Can we file my petition in Dubai/Abu Dhabi since I am working here and will not be going home to the Philippines anytime soon. How about my daughter’s- should it be filed in the Philippines or can it be filed in the UAE as well - she can visit in the UAE with visit visa.

Was she under age 18 when you married your U.S. citizen husband?


Of so he can file I-130 for her, and can file it at the same time as yours.  
 

Seems to me that to  avoid CFO, you should try to her a long term visa to live with you in UAE.

How about my daughter’s- should it be filed in the Philippines or can it be filed in the UAE as well - she can visit in the UAE with visit visa. - I think your daughter will have to interview in the Philippines unless she's able to live long term with you in UAE.

 

Just a note: all petitions will be filed in the US. But interview and visa processing will be in UAE or Philippines.

Yes, under 18. She is studying in the Philippines and will not be able to live long term in UAE.  Thanks for your reply.

Noted on all points. Petitions for both of us will be in the US for 2 separate petitions. My daughter is minor. We would prefer to be interviewed in the Philippines since my daughter is there. I will still stay in the UAE while waiting for the interview and will go back and forth to the PH if need be for appointments and interviews. Would that work?

That's a good plan, but you'll only need to return to the Philippines the one time for the medical, vaccinations and interview.  When filing the petitions, together in the same envelope with two separate checks and stacks of paper, your husband should indicate where asked, that you will each apply for your visas in Manila.  This process starts with action by the US Citizen, so time for HIM to start doing his homework or hire professional help.
