Op, based on your current removal petition, a divorce degree is a MUST with the divorce waiver option. Miracles happen but no miraculous approval will happen here without the divorce decree.

You have to proceed with either the waiver or a joint filing.  There is nothing in between the two.  If your spouse refuses to file a joint petition with you, you have no choice.  

BTW, an interview could be months or years away (take a look at the first line of my signature below).   I predict you will get an RFE for the final divorce decree soon.

@crazycat - I thought the interview will be in 2-3 weeks and this is the message i saw in UCSIS website . As of September 29, 2022, we are ready to schedule your Form I-751, Petition to Remove Conditions on Residence, Receipt Number LINXXXXXXXXX, for an interview. We will schedule your interview and send you a notice. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

@nastra30 - Do you know how long it takes for the interview to be scheduled ? As per September 29 this is the status "We will schedule your interview and send you a notice. Please follow any instructions in the notice" .

Our I-751 status has said that since May 29, 2019.  The "As of.." date has changed 3 times since then.

Rocio0010  -  I told my wife last night about this forum and that i have only 2 options and my other question we don't know when the interview will happen  so it will give enough time to talk to immigration lawyer and get ready for the interview, do you have any idea? Your original post made it seem you knew your interview was coming up/scheduled…

 

If all you are basing it on is the website update, that is not an indicator 
 

Once they review your file , they will likely issue RFE before interview is scheduled and give you 87 days to produce divorce decree.

My status has been that for 9 months already. This doesn’t mean that you will have an interview soon, sorry…

That's insane that you are waiting more than 2 years for the interview,  Do you think the delay is based on the field office load or still the petition is in the main office or its just random thing ? its very confusing i filled my i751 on April 2021 and after 17 months

1. I got the status changed to Case was Transferred and a New Office has Jurisdiction on September 15 2021.

2. Now  its changed to ready for interview.

@Family - I was under the impression that my petition is ready for the interview and i ll get the interview in 2-3 weeks, after reading all the responses in this forum it looks like so many are waiting for interview, thank you.

You too have been a bit naive if you thought you would just “ wait “ and see what happens.

@Daphne .That means everyone has to wait min 6- 10 months for the interview ? I Thought each case is unique and do you think someone can have interview in 1 month and for someone it can take 15 months , but there is an average wait time for the interview right?

You seem focused on the wait times and the interview instead of being focused on your case itself. You can’t undo a waiver. Sure, some immigration lawyer will tell you that can do it and take your $$ , but that’s not how it works. 

Why do you care so much about when the interview will happen?  If you had the interview next month, you’d get a denial because you haven’t produced the divorce decree. Even if you are still with your wife, as you said, in the eyes of USCIS you are divorced, so they are expecting to see a divorce decree at some point. Don’t drag it. Divorce, and you two can work things out later on maybe. 
 

Your first mistake was to file with a divorce without the decree in hand. You acted impulsively. Now everyone is telling you to divorce, so that you can get your decree, and you’re on stand by.

“Interview ready to be scheduled” means that the petition is out of the processing center and made it to the local FO. They are the ones to schedule it. Depending on how busy the office is, it might be a couple months to a Couple years.
