Can i work and drive when greencard has expired??

Hello all,

I recently filed the i751 packet, on the 29th of august. My greencard expires on november 10th, as does my drivers licence.

Im wondering, has anyone had any issues with their employer, once the greencard expires?

And can you get a new drivers licence from the dmv?

 

My employer immediately required my greencard when my employment authorization card first expired, so assuming they need something when this greencard expires, is the acceptance letter, confirming the i751 is pending, enough?

 

Also, will the dmv accept the noa and extend my drivers licence? I live in north carolina

 

Any info is appreciated. Thanks guys

Did you get the receipt notice? The notice when presented with your expired conditional resident card will serve as a valid document for the next two years. 

 

It works for border crossings, employment and should work at the DMV.

Hi @omnelson you should be able to replace your SSN card, removing wording "Valid for work only with DHS authorization". Non-restricted card and driver's license is all you need to prove your authorization to employer.

 

Of course you can show your NOA letter with expired green card if needed. You can also use it to renew driver's license.

employer can not demand to see green card

 

Your employer must:

  • Provide you with the entire Form I-9, including instructions for completing the form.
  • Accept your documentation if it reasonably appears to be genuine and to relate to you.
  • Allow you the choice of what documentation to provide. Your employer cannot demand that you provide a U.S. passport or Green Card.

Received the text message 2 days ago but nothing in the mail just yet.
