Background: My father had a stroke that left him with altered mental status and paralyzed.  When my father first had his stroke I dropped everything and stayed with my mother to help her out. However, two years passed and I returned back to school. My mother is now the sole caregiver on my father and things have been extremely difficult for her. She never learned how to drive and now is unable to do so because she has to be around my father 24/7. Things you wouldn't even imagine such as obtaining groceries is very difficult. In addition my father can't receive consist care and  has been missing all of his doctor appointments because we will arrange for a driver to pick him up or nurse/therapist to come to the home and they always either never show up, or arrive really late that he misses his scheduled time. Theres a lot more things I can add, but to sum it up my mother needs the extra help and things are really hard.

 

 

Now question: I was opening to someone about the hardship and they mentioned that this could be a possible case to ask for an expedite under humanitarian reasons: (specifically: illness, disability). My mother has an I-130 application going for her brother and I have one going for my husband. Both have a good relationship with my parents and have showed that extreme compassion to my father and are always willing to help. Can I potentially submit an expedite for both of them under the same reason. It will be easier to have two extra set of hands. My husband would primaliry be staying with my family anyways helping out with them until I finish up getting my doctorate.

For your husband, possibly, doesn't hurt to try.  For the brother (your uncle presumably), depends what stage it is at.

If a visa is not available, unfortunately there is nothing that NVC can do to expedite the petition. Immigrant visa processing is governed by the Immigration and Nationality Act of 1952, as amended, which controls availability of visas. There is no provision within the law that would allow the Department of State to issue a visa to someone for whom a visa is unavailable

 

 I would definitely try for the spouse expedite / can't hurt to try

Thank you so much. Will submitting the same reason for my uncle hurt my husband application if I submit it for him as well?

My uncle is still at the part where they say "case received"  so still waiting for I-130 approval. He submitted his case in February 2013

Yeah, doesn't look like an expedite is possible for your uncle.  I believe he would have to be documentary qualified (DQ'd) at NVC for an expedite to work.  Depending on the country he is from, he has anywhere from 6-13 years before an F4 visa is available.

Thank you for responding, do you know where I can find country specific information about when a F4 visa can be available

Department of State issues the Visa Bulletin monthly.  Here is the bulletin for August 2022.  Just a note, the spousal visas or other IR visas will not be found here since there are no quotas for those.

I would focus your expedite on the relationship between your Father and Husband. that seems the most obvious route, like others have said your Uncle has a long way to go.
