Thanks, so if I go ahead and renew my passport right now (while I wait for the DS5535 to be processsed, passport was returned at interview expires in about 6 months as of today ), will that cause any issues when sending in the new passport for visa stamping? Obviously the new passport will have a new # that will not have been mentioned to them before?

I’ve seen similar cases that had no issues.

I renewed my passport while waiting for the DS5535 to process.  When they requested my passport back I sent both my old passport and the new one with a cover letter explaining that I had renewed my passport and had a new number. It didn't seem to be a problem and they issued the K1 visa in my new passport and returned both passports to me.

Thank you!! Our last defendant was served May 11th and their answer to the lawsuit due by July 10th. So June 21st status changed to issued and then got the passport on the 23rd which is way faster than we expected!
