My stepdaughter would like to become a citizen. She and her mom (my wife) arrived 5 years ago. However, it took about 15 months for them to receive their green cards. The rule for Form N-400 states that you must be a permanent resident for 5 years for my daughter (3 for wife). Did my daughter become a permanent resident when she arrived in the US or ONLY after receiving her green card. That's important to know so her N-400 doesn't get rejected. I did a lot of google searches but couldn't find an answer. Thanks in advance.

1. How old is she?

 

2. did she enter the USA on an immigration visa? You profile   says K-1 but just being sure. If she entered on a K-2 then she did jot become an LPR until her gc was approved. You should look at the “resident since” date on her green card.  That is generally the date when one officially became an LPR.  

 

3. did her mother  naturalize?

 

4. did you adopt your step daughter?

Mike E asks those questions because of the rules for naturaliztion of the child/  he can guide u if u answer his questions

 

For your child to automatically become a citizen when you did, your naturalization would have had to occur before his/her 18th birthday. If your child has had a green card for at least 5 years and is over 18, he/she may be eligible to apply for naturalization on his/her own by completing the N-400 application.

checked her physical green card. count from that date on the card + 5 years minus 90 days for early filing

Also if she is under age 18, she is not eligible to file N-400 on her own.

She's K2 and 24 years old now to answer some of your questions. Also, did not adopt my stepdaughter and her mother is still a green card holder who can apply for citizenship.

Your stepdaughter became an LPR on the "Resident Since" date listed on her green card.  The earliest she may apply for citizenship is in 5 years minus 90 days from that "Resident Since" date.  Check the date here -- https://www.uscis.gov/forms/uscis-early-filing-calculator
