Got the 221G form to submit sponsor's 2021 tax transcript even though I had it with me. Also, we are to find a joint sponsor which we both know we do not have. However, what we do have is over $70k in savings. How do we use this rather than a joint sponsor even though a joint sponsor is what was specifically asked for.

Who asked for the joint sponsor?  Consulate, or NVC?

Consulate. Petitioner made over $38k in 2021, that qualifies us for a household of 2. She is going to make $23,484 this year from social security, that still is above the poverty guidelines for a household of 2. The IO decided on the joint sponsor the moment I said my wife doesn't work anymore. She didn't even listen to me when I said it was because of the accident on which we expedited our case.

$38k is previous income, not current.  Current income of $23k is marginal.  The consulate officer has full discretion when it comes to the public charge, and their evaluation of your sponsor's financial situation is based on a totality of circumstances, rather than just numbers.   I do not think you have a choice but to find a joint sponsor.

This makes a whole world of sense. Thinking about it now, the consular woman was actually sweet, patient and understanding... she took her time to take my questions and checked the documents I gave her in support of my case and why she shouldn't issue me a 221G form, she actually returned the form twice to check my documents after listening to me. 

 

Now I'm not mad about the 221G anymore 😁. I'm sure we will find someone.

Hi.

 

Do you mean we can redo the I-864 with proof of assets even though CO asked for joint sponsor?? 

Can we then include a note explaining why we didnt send joint sponsor I-864?

if the USC has assets to satisfy the petition , she can use them

if CO still wants joint sponsor , then get one

So I am submitting the documents tomorrow with a note that says 👇👇👇

After deliberation I have found that my wife is qualified to sponsor me based on assets. Documents submitted are: 

 

1. Updated petitioner form I-864 showing asset (savings)

2. 2021 Tax transcript

3. Screenshot of bank account balance *

4. Passport. 

 

*Account name

 Account number

 Bank name.

 

Kindly review 

 

 

What do you guys think??

To use assets, a new form stating and documenting the savings (liquid assets) is needed.  However, the OP said Social Security, not SSI.  If it IS SSI it isn't counted at all because it's temporary.  If it's SSDI, (Disability) then it DOES count and IS considered.  That with the savings will probably carry the day, (if it's SSDI not SSI) but it will still be a judgment call based on "totality of circumstances" which actually include the applicant's employability.

 

The decision is (as has already been said) not just about numbers.  Consular Officers are assessing the whether the visa applicant can and will be supported by themselves and the petitioner.  Any joint sponsor is wise to make their own decision about that, because if the couple does not self sustain, the Joint Sponsor potential liabilities.

Yes, and I concur.  Please clarify whether she is receiving Social Security Disability Income (SSDI) or Supplemental Security Income (SSI).  It makes a difference.

Thanks chief. My partner says it is just social security, not SSI or SSDI.

So she is over 62 and it is Social Security Retirement income?  Social Security need not be connected to any accident.  You just have to be old enough. Maybe she filed at say 63 instead of 66 because of the accident? Maybe nothing at all to do with the accident.

That's right she's over 62 and it is retirement income. She didn't file social security because of the accident, in fact she has been getting SS for 4 years now even while she was a Charge Nurse RN.
