Hello everyone 👋

We need guidance, please, from the people here that had experiences on applying for the spousal Visa.

So, my husband and I wants to apply for a spousal visa but we do not know where to start and if we need to prepare any paperwork to start the process and which paperwork are those, which site to go to and which forms to get. We have zero idea at the moment. We are on search for infos. We want to do diy and we would appreciate if any one here could lead us to the right direction, please. 🙏 

Also to add a background,  I am the benefiary, my husband is from the US and I am from the Philippines. We got married on December 2021 through Utah County. I have a child from my past (not my husband's child) that we want to include with me on this process. Do we need to prepare any paperwork for the initial filing? Where do we start the process? Which site to go to? Which forms to fill up? Help please.

Did you see each other (consummate the marriage) after the Utah ceremony? If not, you cannot file until you have been in each other’s physical presence.

If you guys did consummate after the Utah wedding go ahead and file form i130 on USCIS.gov and be prepared to prove a bona fide marriage. Once the i130 petition is approved if it’s approved USCIS will notify you of the next steps

Start by studying this guide. 

Then download the I-130 and I-130a and the PDFs of their instructions.  Become A-Students of both.

 

Note that your husband must visit you in the Philippines in person before you can start anything.  Has he done that yet?

My husband visited me on April, just last month, we consummated our marriage, we took pictures with my child and our family here in the Philippines. 

 

I've been reading about l-130 and the l-130A, so my husband has to file for l-130 and l-130A for me and l-130 for my child, is that correct? 

 

Also another background about me and my child, I was not married to my child's dad, my child is 7 years old, turning 8 years old, my child lives with her dad's family for 2 years now, but, I'm getting her soon, cause now it's my turn to have her, I heard that we no longer need to get a Affidavit of consent from my child's dad because my child is no longer below 7 years old? Is that correct? I was told that we only need to get a sworn Affidavit? But this is still between me, my husband and my child. My child's dad is not part of the sworn Affidavit, is that correct? So, my child's dad is not consistent with his decision to let me take our child with me in the US, sometimes he says, it's okay, I can take our child's with me and then he would change his mind. So, I wonder what kind of Affidavit I need to get from my child's dad to seal things, to have a proper documentation to show if he continue to keep changing his mind every time. I do understand why he keep changing his mind though.

You NEVER needed an affidavit of consent from the father for a child born out of wedlock in the Philippines, UNLESS, there is a court order sharing custody.  If there is, then you still need consent.
