That's fine. B denials have no bearing on immigrant visas, being married or not married at the time is not relevant. A whole slew of people here experienced this, where their spouses applied for B's, got denied and then later applied for either K-1 or spousal visas. Same thing happened to us. It was never mentioned again. You just have to state on the DS-260 that you had a past visa denial, that is all.

I was actually able to fill out the DS260 using the case number cyprus gave me.

I am really just confused on why they are taking so long and they are so bad at responding to emails.  Ukrainians are suppose to be prioritised for processing.

Every embassy is different. Some are really good at responding and others drag their feet. If an embassy doesn't get a lot of DCF requests, I imagine they might be slower than others. Compared to Frankfurt, London and other embassies that have historically processed DCF applicants.

 

It's weird that they say it's under "administrative processing"....where are you in the process again? Did your wife have her actual visa interview yet?

We only filed the I-130 at the embassy on march 24,2022. We were both interviewed at the interview.

They told me two times it was under administrative processing with the USCIS. 

 

This was the email they sent me when I asked what the process was before attending the i-130 filing. 

 

Both petitioner and beneficiary must appear in person for the I-130 Petition filing, the interview will be conducted by a US consular officer. During the interview the I-130 Petition fee must be paid and petitioner will submit all required documents and completed forms.

 

If the officer approves the Petition, beneficiary will be given instructions for the second step and there will be additional administrative processing.  We cannot give a timeframe of how long the processing will take.

 

Note: the beneficiary must be able to remain in the Republic of Cyprus for the duration of time it takes to process the immigrant visa application.

That's definitely the part I'm not familiar with.

 

The whole process seems very different from when we did DCF, I wish I could help more. It's just odd to see "administrative processing" at this step as that it is usually something that happens after the visa interview (the final interview.)

 

I don't see any red flags in your case so it sounds like it's stalled somewhere on the USCIS pipeline. I would be shocked if your petition is denied.

We even were able to get the police certificate today from Ukraine showing no criminal record. Im wondering why it even went down the USCIS pipeline. The NVC or USCIS does not have the petition I called both of them.

They also sent me this email. It sounds normal I guess. 

 

The I-130 Petition is currently under administrative processing with USCIS.  Once processing is complete this office will notify you.

GOOD NEW I-130 WAS APPROVED!!!

I was able to speak with the Consular from the embassy who conducted our interview today. He told me that the I-130 was approved and it was sent to USCIS to give the embassy a green light to proceed. It seems like the DCF is like this now.

O yea!!! We have all of the documents  translated and printed out along with my 2021 taxes the I-864 and financial documents. I completed the DS-260 also.

Hello, not yet. We are still on Cyprus. I emailed them today to see if we can attend the medical appointment since we have the DS-260. Do you have a DCF pending?
