DCF exceptional circumstances - medical emergency? (split)

Good day....

 

I am a newbie, and apologize in advance for my lack of knowledge concerning the process involved. Hence, that is why I thought I could use some guidance from others that have successfully navigated the journey of obtaining a visa. 

  • I'm resident of Florida. 
  • Husband in India.
  • Met online: Sept. 2021
  • Married: 3/31/2022
  • DCF special circumstances: medial emergency?
  • In process currently:I-130 & I-130A
  • Ordered 4/4/2022: Apostle processing of Marriage certificate

 

Questions:

1) Medical emergency - benign brain tumor on brain stem - requiring that I seek brain stem surgeon specialist for possible future surgery....Does that maybe qualify me for consideration maybe???

2)Whom do I specifically contact to see if they would permit DCF with special circumstances (USCIS Field office, DOS, or the consulate in New Delhi, India)?

 

Closest USCIS Field office to me is Jacksonville (JAC)

If you're not living abroad, then you'll have to file via the lockbox and request an expedite. DCF is only available for USC's who live abroad. It sounds like you've already filed the I-130? If so, request an expedite with USCIS:

The US embassy in India. You would need to contact them directly and put in a request. Again, the USC must be living abroad in that country in order to qualify. Also, it seems you've already filed the I-130 and you do not live abroad, so DCF would not be an option for you.

You married on 3/31/22 in India ? Did u file online from India or immediately returned to the US? 
Asking only to understand what/ how you submitted initial filing of “ in process I-130”.

 

You do not need “ Apostile processing “ of Marriage Cert , just document itself and translation .See visa reciprocity https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/India.html

 

If you already filed AND got a case number, then immediately ask for expedite, you probably won’t even be required to submit medical follow up evidence ( one page  letter from doctor w diagnosis, prescription meds and treatment protocol) .

Have you already filed the I-130 stateside?  If so, DCF is no longer available to you.  As @millefleur stated, request a USCIS expedite.  Good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you! I did request expediate via online with USCIS.  Is there another way to request expediate?  Special email address or phone number.
