Unfortunately, my husband and I getting a divorce he been in the states for a year this has been a nightmare..    I’m sponsoring him and marriage base green card will expire in March of 2023 he will need to have his conditions remove.  Once the divorce is finalized and the visa expires  will I still be sponsoring him?? I would appreciate anyone help on this matter. Thanks

Yes you will, divorce does not change your obligation. Also the I 864 has been used in divorce settlements.

 

He  can file to remove conditions as soon as the divorce is complete.

visa status does not matter after he already entered. green card is not a visa, he can file to remove conditions on the green card independently of you once the divorce is finalized. you are still the sponsor and on the hook for I-864 till any of the below happens

  • The death of either spouse.
  • The spouse seeking a green card becomes a U.S. citizen.
  • The spouse seeking a green card has worked for 40 quarters in the United States.
  • The spouse seeking a green card moves out of the United States permanently.

Hopefully you’ve read the instructions on the I-864 when you signed it. It’s a binding contract between you and the government until he dies, works for quite sometime., or naturalizes

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

@N & K I would suggest reading again the terms & conditions of the I-864. You are responsible to "support" him up to the federal poverty line for your household size - I think, if I recall correctly. You would also be responsible for paying back means tested benefits if he chooses to get those. Again, I am paraphrasing here. He would actually have to choose to live in poverty to even try to enforce the I-864. 

Bottom line is that you are not on the hook to put him up on a condo overlooking the beach or supporting him 100%. Truth is it would not be very much money and he is way better off getting a job and being productive member of US society.
