In desperate need for help. My case was just approved and transferred to NVC. However, I just saw online that it was assigned the wrong Consulate for the visa interview (see attached). I’m a citizen of Spain, but was residing in Canada at the time of application. We made it very clear that we were going to process the case from Spain in our I130 as I was just in the process of moving back, we even wrote a letter, but apparently it was overlooked. What’s the best way to HANDLE this or CONTACT them? This is very frustrating as I hear it’s hard to change locations.  Should I wait to pay NVC fees until I get assigned the right Embassy in Spain? I’m freaking out. Thanks for your help.

NVC generally assigns the location based on the residence at the time. So your letter didn't matter.

 

If you have already moved back to Spain, email NVC requesting the transfer of your interview location to Spain. Attach evidences that you moved like boarding passes or stamps and a copy for your passport.

 

You can start paying fees and submitting DS260. NVC will assign your case to the embassy in Spain while they are processing it.

Thank you, @arken , very much. A couple more questions:

1. By “email NVC” you mean “submit Public Inquiry Form”? Is this the best way to contact them?
 

2. I don’t have passport stamps with the trip (move back) to Spain. In fact, I travel to Portugal and then I take a bus here because it’s closer to my Spanish location. But I do live in Spain, and I recently renewed my passport here. I can attach copy of my new passport, although the bio page doesn’t say current address (just “place of birth”). However, the recent renewal date ("date of issue") is reflected there, plus I have an email from the police (in Spanish) with the appointment for such interview. Will that work as proof of residence?  Will the email need a translation? I also have a letter I got one month ago with my police certificates from Canada in Spain. Just wondering if this all will work, or what other proofs of residence I could submit to show them I live here.

3. Will paying the fees NOT make matters worse? I would like to pay now if possible, but do not wish to for my case to move along with the wrong embassy. If you say that does not affect my case, then I’ll pay now.

1. Best to email asknvc @state.gov , always include case number, your name DOB at a minimum.

 

2. Provide anything that helps. Any itenanaries, your current adress, copy of your latest passport.

 

3. paying fees doesn't affect at all.

Just to be clear, you do not need evidence you moved back to Spain.  You can interview in Madrid, even if you are still living in Canada or elsewhere.  You have two choices.  Country of Citizenship or Country of legal residence.

Thank you, @pushbrk , for the information. Do you think I should email both (NVC and US Consulate in Madrid) to notify of the change of venue for interview location? Or will emailing BOTH cause more confusion (and possibly generating two different case numbers)?  I'd like to be as clear and efficient as I can.

NVC will handle it.  Until they do, Madrid has no information about you.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
