I applied for advance parole I-131, but I need to travel in the immediate future. What should I do if my advance parole application is still pending?

On the other hand, when you filed for AOS you had to have a sponsor that would take care of your finances. That's an argument USCIS can use to deny the expedite.

That didn't stop them expedite the guy you just posted a trhead for who had medical bills?

And he just mentions medical bills, but he said he didn't submit them as part of the evidence, so that's a moot point in this case.

Don't believe everything you see or hear is not facts. Leaving means you abandon your AOS.It's noted in the I-94 try coming back and they will know whats up. Not a chance worth taking.

There was a post here recently when a guy had to go instead of his travelling wife to expedite her travel document and they gave ti to him and he fedexed to her and she managed to enter.

Note that Form I-131 is used by many different applicants: https://www.uscis.gov/i-131 "Use this form to apply for a re-entry permit, refugee travel document, advance parole travel document (including parole into the U.S. for humanitarian reasons), or advance permission to travel for CNMI long-term residents."

 

Do not confuse a re-entry permit (which is only for LPRs) with Advance Parole (which is for AOS applicants). A re-entry permit is what can still be approved if the applicant is traveling abroad at the time of I-131 adjudication, as long as the applicant filed the I-131 while inside of the US and attended the biometrics appointment for it (if applicable). https://www.uscis.gov/sites/default/files/document/guides/B5en.pdf

 

Your I-131 case is for Advance Parole. If you leave the US before your I-131 is approved then your I-485, I-131, and I-765 would be abandoned. See 8 CFR § 245.2(a)(4)(ii)(A) : "The departure from the United States of an applicant who is under exclusion, deportation, or removal proceedings shall be deemed an abandonment of the application constituting grounds for termination of the proceeding by reason of the departure. Except as provided in paragraph (a)(4)(ii)(B) and (C) of this section, the departure of an applicant who is not under exclusion, deportation, or removal proceedings shall be deemed an abandonment of the application constituting grounds for termination of any pending application for adjustment of status, unless the applicant was previously granted advance parole by the Service for such absences, and was inspected upon returning to the United States. If the adjustment application of an individual granted advance parole is subsequently denied the individual will be treated as an applicant for admission, and subject to the provisions of section 212 and 235 of the Act."

Depending on where you filed, the I-824 can take upwards of 24 months to process.

No, for an info pass appointment only you need to go.

You mean if you go once and your request is denied? You can try, but if it is denied because they didn’t deem it as “urgent” I don’t see them changing their mind.

what if in future a different emergency reason arises? Would they consider the case without taking into account the first denaial?

That one I’m not sure because I don’t think I’ve ever read about a case like this in VJ. However, I want to think that they would consider the case if it’s a different situation!
