hi

I was told to ask here from reddit

my sister lived in the usa with greencard with my citizen parents. She were minor

but they didnt apply her for citizen 

last time she were in us 2007 her greencard expired 2010 and now shes 22 with all the documents and evidences and she want to apply for us citizen/passport what she needs to do now please need help im in the united states how can i help her

when she contacted the us embassy in algiers they kept telling her about sb-1

what first steps to do

SB 1 rules are:

  • Had the status of a lawful permanent resident at the time of departure from the United States;
  • Departed from the United States with the intention of returning and have not abandoned this intention; and
  • Are returning to the United States from a temporary visit abroad and, if the stay abroad was protracted, this was caused by reasons beyond your control and for which you were not responsible.

 

She met 1st qualification but not the next 2

She has been out since 2007 so hard to prove she did not abandon and had intent to return

It was not a temporary visit to Algeria

 

Parents should consult a qualified immigration attorney and see what he says

Did her parents naturalise when she was in the US as a PR, that seems to be the question.

She may be a US Citizen and just needs a Passport, unclear.

She needs to apply for a US passport

She needs to fill out and submit a passport application, submit it to Citizen Services not the visa unit.

She needs her parents naturalization certificates as well as evidence of her status in the US at the time of their naturalization.

SB1 is not applicable here.
