apply for K1 visa when both parties are overseas

Timeline

my partner and i are currently in china working ,but we plan on leaving to the states to get married by June. Can we apply for  a K1 visa whiles we are still in china for us to move together? also as foreigners here in china we cant get married here.

Have you considered getting married via Utah? You can then file the 1-30.

K1s are currently taking an average of 283 days (NOA1- NOA2)

And the latest information shows NOA2 to interview in China is around 3 months. 

I don't think you'll be able to move to the States together by June.

Most people can expect a period of separation when it comes to US immigration, regardless of which visa they go for.

 

There is no way she would have a visa by June of 2022.

@martin shawn probably not the news you want to hear.

 

If your partner is unable to stay in China after June 2022 you should indicate on the petition they want to interview in their home country. 

They should also apply for their police background check for China before they leave because a lot of members have reported difficulties in obtaining the report after they've left China. Have a look in the China forum for info on getting the background check if you don't know how.
