Good morning, 

 

my husband and I just sent in his removal of conditions I-175 packet and it has been received. However, I’m not sure if this Is too soon to discus. But I was wondering if anyone knew the process of how and when my husband can apply to become a us citizen? What is the procedure and when can he do it?

If he meets the requirements under the three year rule, he should be able to apply for naturalization in about a year regardless of the status of the ROC application.  You or he can start reviewing the requirements for the N400 including the instructions, and the guides here.  The N400 is much simpler than the ROC, and there is a lot less required evidence.

 

You can calculate the exact early filing date by taking the resident since date on his GC, add three years, and plug it in to the calculator.  For instance if his GC three year anniversary date (not the date of the marriage anniversary) is 3/15/2023, he can submit the N400 on 12/15/2022 as long as he meets all the other requirements such as physical presence.

Also, added to what @Dashinkajust said, the application is online. And because of that, there seems to be a glitch in the system where if you apply on the exact same date where your window opens, the application might be rejected because it is still a day early in the coast where they receive it. I’m sorry if I’m not being clear, I just can’t find the exact wording. But the bottom line is better wait two or three days after his window opens. Good luck!

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

May 1, 2020 Card in hand

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

It’s just better to file by mail since there is no way to predict the clock drift of the computer USCIS uses to time stamp online N-400 applications.
