I chose to deal with those issues than just moving on…..Besides, I couldn’t have filed any other case anyway because the case was for IR-1 visa. Again, there were many-many red-flags in my case.

Hi so we was approved in 2019.   Case sent to Haiti.  Last September.  Still no interview date

although the form has a space that could indicate rejection of my visa application it was not checked, or did they stamp a refusal on the passport , the case is now back at USCIS

So hi everyone after a almost 4 year process for K-1 visa two years  waiting after the interview for the visa I recently a letter yesterday saying that my application was rejected because the applicant was not free to marry We gave them all the divorce papers divorce documentation and this is what they come up with I I don’t even know this don’t make no kind of sense and this is the reason they give me after they gave me the run about for two years after the interview not giving me an answer every single time I called asking for papers and now I don’t know which way to go because the court system granted the divorce legally,

Did you send something with the petition or submitted something at the interview that might have been interpreted that you two are married? For example engagement party pictures ? That could be interpreted as being married. Suspicion is all they need to determine that.

 

Anyway , as said previously, there’s no appeal with a K1. So your next step is to either file another K1 or go with a CR1 (recommended).
