Am writing on behalf of my friend who’s residing outside the United States but he’s a citizen of this great country .. He met a lady about two years ago and good for them they had a baby but they are not married couples yet . 
 

The lady  has been to the American embassy twice to Obtain a visa but unfortunately he was denied in all the two occasions. One was a tourist visa and the other one was a fiancée visa with somebody my friends has no Idea about . 
 

my friend has an intention of bringing the lady and the baby to this country since he has been offered a job opportunity in America .

 

my question is , what kind of visa do you guys think my friend should apply for the lady and the baby to avoid another refusal. Thanks .

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The denied visa applications will come into question. 

They can marry there and go CR-1 route. This is the best. This begins by filing I-130 for wife.

Or they can do K-1 and then marry in the US. I don't recommend this.

If your friend isa USC and stayed 5 years in the US after age of 14 (I think - not sure of age), the child is already a citizen. They'll then have to do CRBA. If he just recently became one, then they will have to file a separate I-130 for the child.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
