Facts: USC spouse sponsored  K-1 entry in 2018;  AOS  completed 12/2019 now preparing  ROC form I-751.

 

We completed Biometrics  after K-1 entry and have a copy of our USCIS stamped Receipt  showing  Biometrics completion in 2018.  

 

Page 2  item 2 of the I-751 Instructions states we do not need to submit Biometrics fee as there is USC spouse

which fairly translates into having already completed Biometrics.  Instructions further state they will notify us if further Biometrics & fee is needed.

 

Problem  is my wife is having doubts (driving me nuts) so I'm posting on VJ (like a good spouse lol). 

Further,  our evidence is strong  we're a solid couple and have abundant  documentation. 

Does anyone have a solid answer to whether we need to submit the Biometrics fee with our I-751 submission?

Page 2 Item 1 clearly states that you must pay biometrics upon submission. It is the "USC" and "LPR spouse" who doesn't have to. Although rare, what it means is, if they need the citizen one's bio, they will send notice for a second fee.

Your understanding is wrong:

Item 2 is for the USC biometrics. It is saying you don't need to include the biometrics for the USC at this time, if they need it they will ask for it.

 

You look at item 1: Biometrics fee need to be included for conditional resident filing for ROC.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Yes.......the answer is yes, you must submit the fee.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
