Hey.

 

I was married to a US citizen for 2 and a bit years. She cheated/didn't care and we divorced just before the marriage conditions on my green card were removed. She dumped me off at the airport and I moved back to Ireland.

 

My issue is that many of my lifelong friends are from the US and I was hoping to visit at least one of them on a VWP after the Covid issues have calmed down.

 

Does anyone have experience with this situation? I am concerned that I will be turned away at the border and furthermore, never be able to visit my friends again. I would anticipate them giving me special attention at the border given my aforementioned history, but I don't know if they'll just flat out reject me. It's all pretty upsetting.

If by out of status you mean did I ever breach my visa conditions? No. Everything was by the book at every step of the way and I was out of the country before my visa expired while the divorce papers went through.

Then I do not see an issue, well apart from the current President Proclamation

Based on your initial post, you had a conditional green card.  Did you formally relinquish it?

In what sense? My ex-wife notified them that we would be divorcing, effectively voiding my conditional green card. I still have it in my wallet, but it is of course expired.

The I407 is the form to give back one's GC (conditional or otherwise).  Since the removal of conditions was not completed, I am not sure what your status looks like in the system.

Systems which seem to have issues communicating, you will get a receipt to show that you closed things correctly

Hmmm, okay. I'll get on this and hopefully that will "reset" my status on their system.

Gotcha. Thank you for the information. Should the mailing address by the same as is listed here ( https://www.uscis.gov/i-407 ) for USPS even though I'm posting from the UK? Would posting through the Royal Mail be sufficient? Or should I look into a courier service?

No, that would not void your green card.  Removal of conditions was in your hands...not her hands.  It sounds like you were misled. Did you seek legal divorce or immigration  help before you left?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Honestly, I was so distraught at the time that I didn't really give it much thought. I just got out of the country and back here before I got stuck, because it was around about the time Covid was kicking off. From what other folks are saying, it seems I'll be sorted once I post the I-407

You mentioned earlier you were in Ireland.  I believe US CBP has offices in Dublin and Shannon, that might be easier.
