Looking to double check on a couple of things

Hi all, been a while. Just wanted to double check and make sure I'm looking at these actions with my Husband to be sure we're submitting it on date/correct time.

 

My Husband's conditional green card expire on 8/19/22.
If I'm reading this right, to submit the I-751 form within 90 days from expiration date as on May 21, 2022. If so, I'll hop on the I-751 May 2022 train topic.

 

Additionally, to submit the N-400 will be on July 15, 2022. We got married in July 15, 2019 Thru K-1 Visa. I don't know if there is a N-400 train topic or not, didn't look yet lol.

 

If not correct, please update me on how it wasn't and how could I look for more accurate timing and structures to take. Thank you very much VJ.

No.  Earliest filing date for N-400 would be 3 years - 90 days from the "Resident Since" date on your husband's green card, not your wedding date.  So that would be some time in 2023 for your husband.

As previous poster noted you can file for citizenship from 3 years from the date of your green card (assuming May 2020 in your case?) - not 3 years of marriage. You can apply 90 days prior. Good luck- still have a few more years.

Hello to both!

 

Thank you for correcting me. My Husband's 2 year conditional green card states that the Resident Since: 08/19/2020. So that would mean the N-400 filing date would be... oh wait the site doesn't seem to be working?

 

On the other hand, my Husband's 2 year conditional green card expires on 08/19/22. He is also worried and not sure what to do with the driver license part because it expire on that day too.


I guess these are corrected?

It's working.  It says on the page to enter the "Permanent Resident Anniversary Date", either the 3-year date or the 5-year date.  So the date you enter should either be in 2023 or 2025, not the "Resident Since" date in 2020.

I'm still confused. My Husband entered the US on June 12 in 2019. Would that be the Permanent Resident Anniversary Date? Or what exactly is that?

What is the "Resident Since Date" on his GC? Add 3 to the year of that date, that's the anniversary date.

Because your husband entered with a K1 visa, his US entry date is not relevant for ROC and naturalization.  What matters is the "Resident Since" date on his green card.  So his Permanent Resident Anniversary Dates would be --

• "Resident Since" date + 3 years = 08/19/2023
• "Resident Since" date + 5 years = 08/19/2025

I'm guessing these are the date and I'll be watching and preparing! So much had happened lately. Most are good.
