I-751 May 2021 Filers

I am excited to get my NOA in the mail in the next few days to week! I don't care where it lands and I don't care how long it will take! I can only hope to not get an RFE and have the interview waived when that time comes.

Hi May 2021 filers! This is my first post here. My wife and I mailed our I 751 package on 5/24/2021, and it was confirmed delivered on 05/28. A few days later, I looked back at my check book and noticed that I had written "U.S. Department of State" instead of "U.S. Department of Homeland Security." We were so disappointed, because we had double-checked everything for accuracy, and took every step to provide as much evidence as possible (tax returns, bank statements, insurance information, leases, pictures, etc.). We even double hole-punched the whole package across the top! 

 

We know that our application will be rejected, and we have already re-printed a new application and supporting documents. When do you think we will receive the rejected application back? My wife's GC expires 08/22/2021, and we're afraid we won't hear back in time to refile before then. Do we need the I-797C that will come with the rejected application before we can refile? I've seen conflicting statements online about whether or not you need it.

June 4th 2021     -     Received Text Notification for SRC case number. (4-8.5 months processing in Tx)

I got my text  with regards to i-751 receipt - We're in Texas but somehow got MSC - Not great news with regards to processing times.

 

It was sent on May 26th so not too bad of a wait to hear.

 

My GC was due to expire today, a question from that, now that I have an MSC number does it mean the I-751 wasn't rejected and I can breath a sigh of relief for now that I won't have to re-submit after it's expired?

 

 

I always worry about these things!

Yes, you may take a breath. USCIS found no immediate or glaring issues with your filing and did not reject it. Thus, they accepted it.

 

frankly, I don’t really understand how they assign service centers. Apparently, they route to MSC any I-751 that may or will require an interview. 
that said, they could waive the interview or schedule anyone from another service center for an interview.

 

 

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

Yes because they sent you a number it means they have "begun" processing your form. The payment went through and you signed and filled everything correctly. 

 

After this youll receive your extension letter in the mail. once you do SCAN and COPY it multiple times and carry the copies don't carry original unless you are traveling outside the country. 

 

RFE, fingerprints and interviews all come later in the processing. but for now you can breath!

You filed the first one pretty early so I think you would have enough time even if it's rejected. I would suggest calling USCIS at some point to get more clarity on it.

At least you know clearly what might be the possible cause of rejection, so resembling the docuemnts and refiling without waiting for the notice/explanation to arrive is less risky than refiling without knowing why rejected. But anyway, maybe they really want that money and yours will go through no problem:)

We're hoping that it does go through! We even wrote on the cover letter that the check was made payable to "U.S. Department of Homeland Security", and all other information ("I-751 form filing fee and Biometrics" in the memo, A# on the top) is there on the check, as well. I've seen that May filers' checks are being cashed pretty quickly compared to previous months, so if the check doesn't post in the next few weeks, we can be pretty sure of rejection. 

 

Our plan is to wait for the notice in the mail, but if we don't hear anything by early August, we'll just resubmit the package to avoid late filing. Thank you again for the advice and encouragement!

When they send applications directly to MSC most likely they will require an interview. Almost everybody has to have an interview with USCIS at some point. Some at the beginning for AOS and others for ROC. CR1 cases are normally routed to MSC even in they are in Texas. If you got a case number with MSC at the beginning then they accepted your application. How quickly you get the interview depends on how busy your local office is. They won’t be able to send your file there until they have availability. There are a number of cases ahead of yours. For the most part is a first come, first serve basis.
