As the tittle states

 

My fiancé and i have now been waiting just about 10 months now for our NOA2. The processing times for California (were ours was submitted) states 5-7.5 months.

Just wondering if others are experiencing the same delays? i see others with dates much later than ours (NOA1 received June 17, 2020) and they have already received their NOA2's.

 

We also sent in a "Case inquiry" with the basic response stating they basically have no information to give us sadly.

Your case from your timeline appears to be in California.  They are working on 2nd September 2020 at present or there abouts from the information on the VJ processing times.  I would send another case enquiry as from the processing times it would appear that you should have heard something back by now.  If they respond with 'we cant give you further information' hopefully someone on VJ can help with the next steps.

We actually had recently just sent in a case inquiry about 3 weeks ago now and the message we received back was as followed.

 

"Thank you for your inquiry. We recognize your interest in the final adjudication of your pending application/petition and are aware of the difficulties caused by any delay in processing. We regret we are not able to give you a timeframe for when we will review your case but the California Service Center is committed to processing this workload." 

 

Like i stated before seemed pretty generic but from what your stating they should have processed it by now if they are working on 2nd September 2020 which worries me more now.

I have read a lot of delayed cases but never lost.  Maybe they are waiting for your background checks to come back?  Hang in there, mate.  Good luck.

Thanks :D. Also a quick question about the 129-f since im almost at the 10 months since NOA1... what happens if it stays in NOA1 for over 12 months? does that mean we have to resubmit? if i remember correctly the 129-f's expire after 1 year

I'm not 100% sure but I don't think your petition expired sitting at USCIS, but I do know it has expiration date after USCIS approved.

 

(The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed.)

No, a petition that has yet to be adjudicated does not "expire."

 

Some petitions take a little extra time to adjudicate, for various reasons:  background/security checks are a typical reason.

 

All you can really do is wait.

as hard as it is not to worry, I would take their response as they are still processing.  I’m not completely up to speed with how and what causes delays but hopefully they will be able to resolve shortly.

Have you reached out to your senator? It might help to get at least a more definitive answer than a generic "we are still processing".

Our Timeline:

i29F Sent: 9/17/20

NOA 1: 9/21/20

RFE: 4/14/21

RFE Response Sent: 4/22/21

RFE Response Received: 4/26/21

NOA 2: 5/10/21

Interview Date: December 10, 2021

Im assuming your time is going to differ because of the RFE. we have yet to receive one thankfully. Im not sure how long it takes to re evaluate a i129-f Due to an RFE but im guessing it's going to add time to the process. Now if we had received an RFE

i would understand the extra delay but again we have received nothing. We are going to call the USCIS today and hopefully speak to someone about this over the phone. If that doesn't shed any light on the subject, than the next move will be to

contact the congress in her state.
