Delinquent filling of tax returns

Timeline

I was delinquent for a few years of filling my tax returns, but I took care of them and finally filled the returns last summer (2020). Now, it is approaching the end of March 2021 and I still don’t have the tax transcripts, which my fiancé will need for her K1 interview.. Yes I filled my tax return for FY 2020 early so I’m not in the same position. Is there anything I can do about this, either with the IRS or if she doesn’t have the transcripts when she goes for her interview? I gave her a copy of my returns with the W2s, and for FY 2020 I’m printing out copies of my pay reports.

I'm assuming you filed by paper. Unfortunately there's still a huge delay for paper filers. 1040+w2 should work.

If you don't have a transcript, this is what the I-864 instructions say:

If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns.

 

So in addition to your entire federal return (including all attached schedules and forms) and any W-2s, you would also want to include any 1099s you may have. This may have been what you did, but it wasn't clear from the post.

 

Note: I know that the K-1 process uses the I-134 but the instructions are more vague on that form, so when in doubt I would go with the above.

And the IRS Will tell you any thing to make you go away, they lied to me twice.

 

I filed my 2019 on time, by mail and they even cashed my check.  I started calling them in October and they said it would be cleared up by end of December.  December came and they said it would be 8 to 16 weeks and it would be taken care of.  

 

16 weeks came and now they are telling me they will start working on 2019 in June, they are now working on 2020 tax returns.  I was told each time not to re submit my 2019 taxes, well a few weeks I resubmitted them.

 

Maybe one day I will have 2019 tax transcript

I don’t have any 1099s. I’ll just have her bring the 1040s and W2s. Appreciate the info. I just don’t want her to be denied because of paperwork issues, I told my fiance “you prep for the interview, I’ll take care of the paperwork”, hopefully I’m not going to let her down.

When I called the IRS after I filed my delinquent returns, I was told the processing would take 4-8 weeks. It’s been more than triple that time frame 😂. That agency is not the most honest of them all.

Did they really lie? Did the customer service rep know in October that D.Trump would push out another stimulus in late December that needed to be organized for millions of tax payers immediately with new rules. Resources were diverted to that.... checks, direct deposits, debit cards. 2020 tax forms/instructions/programming (Line 30) had to be redesigned to reflect 2 stimulus payments instead of one. Filing season which always opens mid-January had to be pushed to February. Focus had to include 2020 returns. And did the customer service rep in December foresee a third stimulus, Biden’s, being passed in 2021 leaving the IRS to deal with Payouts 1, 2, 3; 2019 returns; and 2020 return?  They were forced way behind, but perhaps you benefitted from the stimulus packages. Saying they lied in October and December when changes had not unfolded yet is unfair. 
 

You can submit a photocopy of your tax return forms PLUS income statements (W2 or 1099) in lieu of a transcript. 
What is your visa? Where are you in the process? A timeline and profile would really  help when you have time.

Yes, they lied.  Even the last customer rep I talked to at IRS said the person I talked to before me gave me incorrect information.

 

I have no W2 or 1099, most of my income is checks and another 300K in credit card revenues.

 

My timeline is: Wife has filed for US Citizenship.  Which I don't really care if she has tax transcripts for that, it just I want the IRS to get my taxes filed and I want to be able to get a tax transcripts

That could be the reason your processing is held up. Is that US income or foreign earnings because you live abroad?

I live in the USA, been filing my taxes like that for decades, never had this issue. This is US Dollars earned inside USA

 

IRS blame COVID, then IRS blames the IRS for the hold up.  I was told both times don't resubmit my 2019 Tax Return by mail.  So last time I went ahead and refiled via USPS and sent a copy of my endorsed check.

 

I have learned from them that they have no clue what they are doing at the moment, I got way too many odd and different answers as to why my tax transcripts are not available.  I bet you if I call them 10 times I will get 10 different excuses/lies.

I had to file on paper last year.  I just now, like in the last couple of days, had my 2019 tax return transcript finally appear in my online account.  I filed with an extension last summer.  It took like 9-10 months for them to process.  I'm owed a return and haven't seen any sign of that yet but at least my transcript is now available.  Keep checking your online IRS account right up to the last moment because they are apparently making a little progress.

  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

I just checked on the IRS’s website, my transcript for 2020 is there, but not for the years I was delinquent. So now what do I do 😂
