Abuse of Authority at Jamaica US Embassy

Sooo, I’m literally about to give up. This is so frustrating.

My spouse and stepchildren in Jamaica have been in Administrative processing for almost 7 months and counting for income reasons (which have been rectified but not reviewed/approved by embassy).


All of the beneficiaries with my case now have expired medical exams and police certificates because of this delay. 

 

I reached out to the embassy to inform them and ask for direction on what to do next.  I was told by embassy that they would be sending the passports back (3 weeks ago) and I needed to contact the hospital to make a new appointment to update the medical exam. The embassy also sent me the instructions on how to get a medical exam and medical history form (which I already had from their first exam).

 

I was told by the hospital that they had to cancel  their appointments because I didn’t have a new 221g requesting an exam. The hospital said they could reached out to the embassy for the 221g and the embassy told them to cancel our appointment. But they just informed me just (2 days prior) that they needed to be updated. Going on 7 months in Administrative processing and counting....... still no passports or further instructions. 


I was told our case was not being processed until their medical and police certificates are updated.

I have sent inquiries about this issue and still no answers or passports?

 

I don’t know what else to do.

Contact your Congressperson and ask them to enquire.

Timeline

Often when something is just stuck an enquiry gets it moving again. I assume this was recently.

 

Maybe somebody else has a better idea but all I can think of is the Ombudsman but that seems to take time.

I contacted my Congressman right after general  election and a month ago. Both times I received a notification from the within 2 weeks. I have never heard of the ombudsman taking on immigration but I am definitely going to try. I’m waiting anyways. Thanks

Not something I am that familiar with, others have mentioned going there.

What you are going thru is what many others are also experiencing / Long AP now because of covid and extended wait times for embassy to even do interviews

Many have had to redo the medical exam (not the police reports ) when the embassy was finally ready to either schedule and/or issue a visa 

so sorry for what you go thru and all the rest here that wait and wait 

and in all honesty a Senator has no influence over what immigration does (as told to me by lawyer i hired)/ Congressmen or congresswoman can only find out and report to you the same info you receive 

 

the Kingston embassy has approved 61 CR1 and 91 IR1 visas in January so they are catching up

The DHS Ombudsman has nothing to do with the case at this point -- they've finished their part and it's already with the Department of State.

I just wish AP had a time limit. It’s unfair that people may have to wait for months and some years just for a decision on their cases. I hope things change soon.

How can it?  If the reason for AP is criminal background checks, and the agencies responsible for providing those checks are delayed, then what?  Approval without complete information on the applicant's past?  Not likely.  More likely would be a denial due to not having enough info to approve.

I am never sure about this. Does not make a lot of sense to me.

 

I can understand a situation where is effectively impossible to carry out full background check. But not where it just takes a very long time. After all somebody visiting they just have a few hours after getting the manifest to carry out a check, why does someone immigrating have so long? After all if you have evi intent why would it matter how you enter.

 I’m well aware of the purpose for AP. Evenbefore covid, AP was known to be abused and also used as a discrimination tactic. These are known facts. Of course they have to verify info but some cases have taken years. No excuse for that. I can understand 6 months but years I cannot.
