I am an international student who recently got married to an American citizen. My wife doesn't meet the income requirements, even though she got a new job in January that would meet the requirement we can't prove this because she hasn't filed taxes and the year is still on.

 

My wife's dad agreed to be my co-sponsor, his earnings are way more than the requirement, but he was laid off in November last year and he doesn't know when his company will call him back even though he's sure they would. He has provided his Tax returns and W-2's but there's a problem. 

 

1) He only has pay Stubs until November 2020. 

2) His main boss quit, so he can't get a verification letter from the company. 

 

Am I better off looking for another sponsor or is there something I can do to still use my father in-law as my join sponsor?

 

Please I need answers. Thanks.

You have a misunderstanding of how current annual income is calculated.  It is determined by CURRENT income per pay period X number of pay periods per year.  Unless your wife is self employed, you do not use her tax return to determine current annual income.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

My wife was self employed last year so we had to submit her tax returns.

 

Could you please explain further? Are you saying my wife can be my sponsor if she currently makes above the income requirements for a sponsor? How do we prove that she does if not with tax returns etc?

 

Your input makes a lot of sense to me, but if you explained further I will deeply appreciate. Thanks

If a person is not self-employed, he/she can use the most recent pay stub to calculate current annual income.

Current Weekly income X 52 = current annual income

Current Monthly income X 12 = current annual income

Current pay period income X number of pay periods per year = current annual income

 

The Immigration Officer will use that calculation as well as other factors to determine eligibility.

This makes a lot of sense. What about the 6 months pay stub they are asking for? Like I said, my wife started working in January. It has only been 1 month. 

 

I am using Simple Citizens and I think they are messed up. They are no help at all. I wasted my money to use them.

If she is employed she will have pay stubs, maybe a contract of employment, employer confirmation of her salary.

We have that, the lady in charge of my case says that she's not qualified since her previous income didn't meet the requirement. Remember, she didn't make enough to meet the requirement last year. But I am kinda confused because her household was 1 last year and I don't know why USCIS uses last year's income to make a decision.
