Can anybody enlighten me?? 

 

If u have an incident of domestic violence from 10 years ago when u were 18, would that affect your petition in any way.

 

The domestic violence case was misdemeanor battery and misdemeanor disorderly conduct both same incident

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Yes, your petition will get much more scrutiny, which could mean much longer wait time at best.  It does not matter how long ago the incident occurred.  The question on the petition form is: "Have you EVER been arrested or convicted of any of the following crimes: Domestic violence, [...]?"

Hi l've asked my lawyer this as I have the arrest but it was completely dropped and the courts also have no agenda/minutes due to it never getting to that point.

 

My lawyer said its mostly important that your fiance knows. It can be brought up in the interview and if the fiance says they arent aware of the arrest - that is more likely to raise scrutiny than the misdeamor itself.

I hope your lawyer advised you to disclose the arrest anyway.  Arrests must be disclosed on the petition form even if the charges were later dropped.

I disclosed everything.. Even a court document (form california courts) indicating no record. no case. I've included it all (which was a lot of no records found, domestic violence lawyer statement, my ex's statement of falsifying AND my arrest report). :)

You are doing all the right things to continue forward without abatement with your case. We have heard from others who have come under intense scrutiny for not revealing an arrest and not providing the proper court documents. Even if it has been expunged the FBI knows as ALL cases are on file. Good luck and stay engaged in the process.
