Timeline

Hi everyone - so I wanted to get some info on the new law that was passed about public charge. I have my mother in law who is a green card holder who just got approved for Medicaid. She is planning on applying for citizenship in approximately 2-3 years time. I was trying to figure out if her receiving Medicaid will stop her from becoming a US citizen in the future?

The issue is more for the Sponsor in the meantime. No public charge rule for Citizenship.

Did you sponsor her?  Whoever signed her I-864 could be on the hook to repay the US government.  That's not new though.

No, it was her son. Any way to know what the costs would be out of curiosity?

Whatever the cost of medical care she receives.

It could potentially be repayment of whatever amount she accepted in means-tested benefits, as evidenced by the verbiage in the form he signed.

Why did she accept Medicaid? As an immigrant and whomever sponsored her is aware, the I864 was part of the process to allow her to immigrate legally, Medicaid is not a benefit offered to her. The sponsor agreed to use his/her financial resources to sponsor your mother in law- (not US tax payers) and agreed to repay the US government any means tested benefit she utilized.

New York and CA you can get it from day one, most other places are after 5 years as a LPR.

Also this isn't something new it has been going on long before Trump
