Conditional Permanent Resident Alien

Hi Guys , I have a question.

I was granted. CR1 ( Visa was issued before 2 years marriage date) However, I entered after my 2 year mark so technically I am expecting a 10 year green card.

Upon entry, I was given a notice to conditional permanent resident alien slip which I signed. It says a petition must be filed to have the conditional basis of my status removed within 90 days immediately preceding the 2nd anniversary of the date i was granted conditional permanent resident status.  Does anyone know what this means?

It would seem to mean that the officers at the POE did not notice you had passed the 2 year wedding anniversary.  If your GC comes and it is a 10yr card, I would not worry about it, but if it shows up as a 2yr card, I would be contacting USCIS to try and straighten it out.

Good Luck!

Agree with @Dashinka.  If you receive a 2 year card by mistake, you will have to submit an I-90 and the old card to USCIS for correction.

Fortunately the people at the airport are not the same people who issue the GCs. The people at the airport are not as thorough when it comes to documents. They look at the visa and stamp your passport accordingly. They don’t have the time or inclination to go through the file and double-check things, because they don’t have to. They just admit people into the country and that’s where their job ends.

The people who issue the GCs are more thorough. In most cases the correct GC arrives in the mail, despite what was said or done at the airport. For the rare occurrence where the wrong one arrives, return it with an I-90 (no cost due to USCIS error) and get it fixed.

If it sets your mind at ease, I was in the same situation. Issued a CR-1 but entered after my second wedding anniversary. I mentioned it to the POE agent but he didn’t really understand and endorsed my visa as CR-1. Fortunately I did receive a 10 year green card.

Met: December 2009

Married: April 2015

Received CR-1 visa: February 2017

POE (as IR-1): April 2017

Oath ceremony: November 2020

Thanks all, just wondering - is it odd to receive SSN in the mail before applying? I see fellow VJers who go to the SSN office after landing to apply for their SSN however, I got mine in the mail within a week of getting in... Idk if I'm just lucky and that was a fluke or the process is now changed.

Does anyone have any advice on drivers license issue?

That's not odd if you asked for a SSN on the DS-260. Maybe a little unusual that it actually worked and that it was fast, but not something to worry about. Your passport with visa and stamp should be fine for getting a driver's license regardless of the issue you described in OP, just be prepared to potentially explain how that works and getting a manager, because some people working at the DMV get confused about it. Some DMVs issue DLs only for as long as your immigration documents are good for, so it might only be valid for a year from your date of entry since that's how long the visa+stamp is good for. I don't think that's always a given, you'd have to research what your state actually does and decide if that matters to you.
