August 2020 - AOS Filers

I got an automated email from USCIS saying "we have taken an action on your case."

It directed me to sign into my USCIS account, but I don't see any changes. The last change was saying that fingerprints were taken (2 days ago).

Anyone else has this experience?

Hello all

I wanted to get some advice here. My brother US citizen turned 21 and applied for my mom August 2020 and she is currently in the US. He sent in all documents along with the I-130 and received the NOA in the mail. When can he send in the 485? Since he did not send it the same time as the 130 should he wait until they send a letter with the next steps?

Guys. I just noticed my status changed for both my daughters and my AOS and I am confused and don't want to get excited?

With USCIS it could either be a glitch or it means they waived your interview. If you get the Green Cards and I-485 approval notices (all separately) then you'll know it's the latter.

I'm hoping it's not a glitch. Both mine and my daughters updated to reflect this but you never know. Guess I will know later on in the week.

Those that got the interview waived received either "New Card Is Being Produced" or "Case Was Approved" update. So IMO it looks like your interview was waived.

I did see those but they were all people who had interviews canceled due to COVID and I never had an interview scheduled at all.

Did you file your medical with your application?

Cilllah most likely didn't need another medical: https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-3

K or V Nonimmigrants Applying for Adjustment [26]

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

  • The medical examination did not reveal a Class A medical condition; or

  • The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions. [27]

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application. [28]

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician.

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

I requested an expedite of my EAD on 2/8/21 and it just got approved 🙏 I am so happy I could run around my complex shouting.
We did not have a job offer but used the following reasons:

1- final stage interview at a biotech company that is the biggest supplier of covid tests in the world

2- financial loss, explaining that we had saved to cover 4 months of expenditure per the processing times upon our arrival but since we got here the processing times have significantly increased and we are now down to zero in terms of savings for basic living costs
