Filing for I-134 when 2019 Tax Return was filed as Joined

Hello,

 

I had applied for K-1 visa for for fiance and received I-797 Notice of Action that it has been approved. Now I am gathering documents ready for filing I-134, but now I realized that I and my Ex-wife filed a join Tax Return for 2019. We have been living separately since 2018, but legally we were divorced in January 2020.

I am wondering how to go about providing Tax Return as required in I-134  form?

 

I would appreciate any advise.

Personally, I’d of filed MFS, given you’d separated... but provided you can collaborate why if asked during the k1 process there shouldn’t be an issue

Actually, I have seen in the instruction for filing I-134 form that the sponsor have to submit, "If self-Employed, (1) Copy of last income tax return filed; or
(2) Report of commercial rating concern.

 

I believe that since I am employed by a company, my bank statement and letter from my employer is sufficient.

not living together is not the same as legally separated 

if you were still married and she was the first to file,  IRS allows and makes you and / or her prove why she could not file adding you as husband

If you do not know what MFS is,  i will assume you filed no tax return

Married Filing Separately. Since she was married in 2019 she has all the right to file that way. How did YOU file your tax return?

I think OP stated "I and my ex-wife filed..." which should answer this
