Hello, I recently spent a month in Minsk, Belarus with my fiancee...and I wanted to know if anyone recommends getting a attorney who specializes with K-1 visas or is it better to just do all the paperwork myself. Any suggestions and/or recomendations would be greatly appreciated. Thank you for your time and support in this matter.

a couple of days ago I was in the same dilemma and the kind people here on VJ gave me great advice. I ended up doing my paperwork myself and it wasn't as hard as I was expecting (should that worry me) it was time consuming more than anything. Each case is as individual as the people. It depends on what makes you more comfortable. We took great comfort in knowing EXACTLY what was going on the form and being able to double check and triple check them. My forms went off in the mail this morning and it felt good, great infact. Now the long wait begins along with much hoping and praying. Hoping to be there for my birthday on 27th Jan, though I think thats bing a bit too hopeful. Good Luck to you.

01/11/2008 - medical (allergic to tetanus shot, requirement waived)

02/05/2008 - interview @ 10am - APPROVED!!!!!!

07/31/2008 - AOS and EAD finally mailed

08/02/2008 - Delivered

08/08/2008 - Check cleared

09/26/2008 - AOS transferred to CSC

09/29/2008 - AOS touched (took out envelope at CSC and put in new pile)

10/03/2008 - AOS touched (probably that RFE coming soon!!!!)

10/06/2008 - AOS touched AGAIN!!! (surely it's an RFE)

I'd suggest doing it yourself. It is not difficult. We did it! The answers for all your questions can be answered here at VJ 24/7. The Guides are great assistance and the example forms give clear advice as to what you need to do. Unless there are some serious legal things happening in your or the beneficiary's life, I would not think a Lawyer is necessary. Other than filing paper and waiting, the Lawyer does the same thing you'd be doing. An attorney cannot make the process go any faster. Save yourself some money. But in the end, you do what makes you comfortable.

If you'd feel more comfortable, maybe having a consultation with an attorney would be best for you in helping you decide. Most of us here didn't use attorneys, but IMHO no one can tell you YES, use an attorney or NO, don't use one. Read through the Guides, look at the example forms to help you make your decision. Best wishes whatever route you take. :)

I seriously thought about using an attorney, and after getting the responses above I did it myself. No problems at all. Met some friends on here who answered some questions, read the guides, example forms, etc.

I actually think it will go faster doing yourself, and more attention to detail. I filed in April, and my fiance got her visa yesterday.

Now I need to read up on the adjustment of status. Take a look at the I-129F, and G-325A. The forms are not difficult.

Technically the process doesn't go faster by doing it yourself. Neither would it be faster through an attorney. Attention to detail and making sure everything required is submitted will most likely prevent RFE's which can result in minor delays.

My advice would be to read the guides and see what all this entails. They are pretty straight forward but like others have said, you need to make sure you have EVERYTHING done right. Some feel more comfortable having an attorney, others don't see the need.

If you decide to use an attorney you should still be familar with the process.

We did it ourselves and he just and our interview and were approved. There was nothing really complicated in our case. No waviers needed or that kind of thing.

Don't know anywhere near enough about you, your fiancee, or your situation to hazzard a guess. But it can be said that an upfront consultation with an immigration attorney is a good and inexpensive investment.

I didn't do that but tend to agree that a consultation is good for many. It is particularly good for those who don't have a clue where to start.

If a person is detail oriented and comfortable understanding and filling out government forms, I recommend they study and ask questions here, then do it themselves with the ongoing support of those who've gone ahead of them.

If a person is not detail oriented, is unfamiliar with forms or can't comprehend the meaning of complex sentences and paragraphs of instructions, they need assistance, whether from an attorney or somebody who can do all the things they don't have the aptitude for.

Barring glarring mistakes that cause RFE's, my anectotal data tells me that using attorneys adds time to the process if for no other reasons than the mailing time and priority for swift action you'll lose control of.

It may not always be about "not understanding the paper work." In some cases, people may just not have time. I've said this in another post, and the main reason I got an attorney for the two of us is because I'm in the middle of a cross country move. It's nice to have someone there to take care of the details when you can't.

Could we have done it ourselves? Certainly. Then it probably would not have taken place until after I got set up in my new apartment. I just wanted it taken care of asap.
