Can my fiance come live with me?

hello,

 

My fiance and I are waiting for our interview date.

She is from Canada and can book a flight down to the United States. 

Does anyone know if this is acceptable?

She can get a 90-day visa and afterwards fly back home. 

Really don't want to mess up our K1 when we are this close, but also don't want to wait any longer to see my darling.

You need to choose words, VWP is to visit not “live”. Of course, she can visit while waiting for K1 interview.

Canadians don't use the VWP.  There is no 90 day limit like with the VWP. 

However your fiance cannot live with you until their visa is granted. They can, however, visit.

Thanks for the responses; that does make sense.

 

To clarify; She would be visiting with a return ticket to go back to Canada at the end of 1.5-2 months at which point she would have to quarantine for 14 days in isolation once back in Canada.

 

Is there any issue with where she stays while here?

Like if she tells the border people thats she's coming to visit her boyfriend and staying with him at his house would this be acceptable.

Not a big deal.  Most people on this forum never bother with the correct fiance vs fiancee . 

Visiting also isnt a big deal but definitely be aware of the pandemic.

A Canadian can stay up to 6 months (180 days) in the US.

But the customs guy has to agree to that.

She would have to prove she plans to come back, so like, a job, or a lease to a apartment. Something a whole lot more than a return ticket (if she stays that long of course, a month or two they prob won't ask)

 

Her going for a few months shouldn't be an issue, I flew down in May and didnt have issues, but since I'm staying for awhile they asked how I plan to support myself, what about my job in Canada etc.

 

Again. It's all up to customs to let her in.

The only acceptable responses to their questions are truthful ones.  Anything else can jeopardize future visas.

It really depends on the border agent. In theory she's allowed to visit, but border agent can always choose not to admit her.

 

I got some issues one time going through Charlotte to visit my girlfriend (now my wife). I was going to be staying for one month. He asked who I was staying with and I said my girlfriend. He said there is no such thing as a "staying with my girlfriend visa". After much discussion he admitted me (I didn't argue with him, said I had no intention of breaching US immigration laws etc), but it was a little scary.

 

Its unlikely you'd get any problems, but its always a possibility especially if the trip is going to be long (few weeks) and/or there have been a frequent or long trips before.
