Hello there,

 

I am done filling out N-400 online and I am little surprised by how little evidence I've been asked to submit by the online tool.

 

I am applying under the 5-year rule after a successful ROC (Removal of Conditions) application with divorce waiver. (We got divorced before the ROC application.) I am being asked by the online tool to submit only a copy of the green card front and back and a copy of the divorce decree.

 

Should I submit more evidences? There is an upload box "Additional evidences" that is empty and get a warning "You should provide evidence If you do not provide evidence, your application processing may be delayed." before being able to click Next. 

 

I am thinking adding tax returns for 5 years, (2019 IRS tax transcript is not ready yet), and maybe a copy of my marriage certificate? What do you guys think? Any other evidence that might be a good idea to submit?

Have you had any trips outside the US for 6 months or more? If so you need to submit your last 5 years tax transcripts 

 

Have you ever been arrested or detained? 

 

Have you ever NOT filed taxes in the 5 years you were here? Do you have any overdue taxes?

 

If any of these apply you would need to submit additional documentation.

I removed conditions with a divorce waiver as well. I submitted divorce certificate, GC front and back, but also I had to submit a letter from selective service (this might not apply to you). I didn't include any tax returns because it didn't ask for it, I might take them with me for the interview.

 

Yes, it's not a lot of documents.

Good to know, thanks. I think I'll just do that. Green card + divorce decree + 5 year tax returns and that's it.

No to all of that. The only thing we took couples of weeks to submit my initial AOS when my tourist visa got expired. (It took a bit longer than we thought to collect all documents for AOS) So I was technically out of status I suppose for these couple of weeks. During the AOS interview, the officer acknowledged the couple of weeks of out of status and say it's forgiven part of the AOS approval. Should I still reply yes to one of the background questions (didn't find any that exactly matches this, only deportation proceedings. I wasn't arrested or deported or anything.) and document it somehow?

Submit only documents requested from you. Take any documents you feel helpful with you to the interview and use them only if needed.

I have found with governments the best path is always to provide exactly what they ask for, no more and no less.  I did not provide tax returns.  I will be taking them with me to the interview.

You don't have to acknowledge the late submission for AOS; it doesn't apply to that question. :)

- Answer the question they ask not your interpretation.

- Read the instructions.

Got it. It's just worrying to have the warning "You should provide evidence If you do not provide evidence, your application processing may be delayed." when getting ready to submit.

it's more a way for them to cover their rears. It's the great American disclaimer.
