Husband F1 visa approved but now Married

Hi My husband was petitioned by his mother when he was unmarried. Got advice by NVC that his F1 visa petition was approved. But we are now married and advised NVC. His status was updated to F3. Now we got advice that petition cant be further proceesed due to numerical limitations. Questions- do we just wait for NVC's next advise when it resumes processing? Or we go ahead with paying fees and gather affidavit of support/civil docs? Any ideas, guys, how long could we wait further? Priority date is 2011 and per July 2020 visa bulletin, date for filing listing date is April 2002 (Philippines). Appreciate your advice. Thanks

Nothing much to do other than wait.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

1. Did you recently just get married? Or when did you marry?

2. When did he receive the notice about his F-1 being current?

Yeah you wait till next NVC notification to pay fees/submit documents. As you already know it’s probably about another decade to go. By the way - it is August 2001, not April 2002 in latest visa bulletin - final action dates in table A is when a visa will be available - table B is just for documents submission.

Married in 2011 but petitioner failed to update. Notice of approval from NVC rcved May 2020.

But the PD is also 2011. So at the time of filing he was either already married or about to get married. Something’s not right here. I can’t see how a parent can overlook such a huge event in their child’s life.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Still unmarried. Petitioner not able to update coz she was advised to file personally and was too busy despite pressure. 😕

For 9 years?

Anyway it’s done now, all you can do is wait.

Hard to believe but it’s a moot point because he will have to wait now. He knew it would be discovered at some point anyway.

Your husband can also update his Marital Status. By the way his Priority Date did not change but the category upgrade to F3 which means he needs to wait for 9 years more 😒
